| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 43.0672, Local Government Code, is | |
| 13 | 13 | amended by amending Subsection (a) and adding Subsection (d) to | |
| 14 | 14 | read as follows: | |
| 15 | 15 | (a) Notwithstanding Section 212.172 or any contractual | |
| 16 | 16 | provision to the contrary and not earlier than the 90th day before | |
| 17 | 17 | the date of the annexation, the [The] governing body of the | |
| 18 | 18 | municipality that elects to annex an area under this subchapter | |
| 19 | 19 | must first negotiate and enter into a written agreement with the | |
| 20 | 20 | owners of land in the area for the provision of services in the | |
| 21 | 21 | area. | |
| 22 | 22 | (d) An agreement that authorizes a municipality to annex the | |
| 23 | 23 | land that is the subject of the agreement may not waive the | |
| 24 | 24 | requirements described by this section. | |
| 25 | 25 | SECTION 2. The changes in law made by this Act apply only to | |
| 26 | 26 | an annexation of an area that was not final on the effective date of | |
| 27 | 27 | this Act. An annexation that was final before the effective date of | |
| 28 | 28 | this Act is governed by the law applicable to the annexation | |
| 29 | 29 | immediately before the effective date of this Act, and that law is | |
| 30 | 30 | continued in effect for that purpose. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
