9 | 9 | | relating to the application of nepotism prohibitions to a person |
---|
10 | 10 | | appointed or employed by a school district as a teacher or other |
---|
11 | 11 | | employee. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 573.061, Government Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | Sec. 573.061. GENERAL EXCEPTIONS. Section 573.041 does not |
---|
16 | 16 | | apply to: |
---|
17 | 17 | | (1) an appointment to the office of a notary public or |
---|
18 | 18 | | to the confirmation of that appointment; |
---|
19 | 19 | | (2) an appointment of a page, secretary, attendant, or |
---|
20 | 20 | | other employee by the legislature for attendance on any member of |
---|
21 | 21 | | the legislature who, because of physical infirmities, is required |
---|
22 | 22 | | to have a personal attendant; |
---|
23 | 23 | | (3) a confirmation of the appointment of an appointee |
---|
24 | 24 | | appointed to a first term on a date when no individual related to |
---|
25 | 25 | | the appointee within a degree described by Section 573.002 was a |
---|
26 | 26 | | member of or a candidate for the legislature, or confirmation on |
---|
27 | 27 | | reappointment of the appointee to any subsequent consecutive term; |
---|
28 | 28 | | (4) an appointment or employment of a teacher, bus |
---|
29 | 29 | | driver, or other employee by a school district if: |
---|
30 | 30 | | (A) the district is located wholly in a county |
---|
31 | 31 | | with a population of less than 50,000 [35,000]; |
---|
32 | 32 | | (B) the district is located in more than one |
---|
33 | 33 | | county and the county in which the largest part of the district is |
---|
34 | 34 | | located has a population of less than 50,000 [35,000]; or |
---|
35 | 35 | | (C) the board of trustees of the district |
---|
36 | 36 | | approves the appointment or employment; |
---|
37 | 37 | | (5) an appointment or employment of a personal |
---|
38 | 38 | | attendant by an officer of the state or a political subdivision of |
---|
39 | 39 | | the state for attendance on the officer who, because of physical |
---|
40 | 40 | | infirmities, is required to have a personal attendant; |
---|
41 | 41 | | (6) an appointment or employment of a substitute |
---|
42 | 42 | | teacher by a school district; |
---|
43 | 43 | | (7) an appointment or employment of a person by a |
---|
44 | 44 | | municipality that has a population of less than 200; or |
---|
45 | 45 | | (8) an appointment of an election clerk under Section |
---|
46 | 46 | | 32.031, Election Code, who is not related in the first degree by |
---|
47 | 47 | | consanguinity or affinity to an elected official of the authority |
---|
48 | 48 | | that appoints the election judges for that election. |
---|
49 | 49 | | SECTION 2. The change in law made by this Act applies only |
---|
50 | 50 | | to the appointment or employment of a person by a school district on |
---|
51 | 51 | | or after the effective date of this Act. A person who is appointed |
---|
52 | 52 | | or employed by a school district before the effective date of this |
---|
53 | 53 | | Act is governed by the law in effect at the time the person was |
---|
54 | 54 | | appointed or employed, and the former law is continued in effect for |
---|
55 | 55 | | that purpose. |
---|
56 | 56 | | SECTION 3. This Act takes effect September 1, 2025. |
