| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 16.343, Water Code, is amended by adding |
|---|
| 14 | 14 | | Subsection (h) to read as follows: |
|---|
| 15 | 15 | | (h) Notwithstanding Subsection (g), the board may consider |
|---|
| 16 | 16 | | an application for funds under Subchapter K, Chapter 17, if the |
|---|
| 17 | 17 | | application is for a water supply or sewer service project that is |
|---|
| 18 | 18 | | located in an area in which the model rules adopted by the board |
|---|
| 19 | 19 | | under this section are not enforced if the community to be served by |
|---|
| 20 | 20 | | the project was developed before the model rules were adopted by the |
|---|
| 21 | 21 | | board under this section. |

| 22 | 22 | | SECTION 2. Section 17.927, Water Code, is amended by adding |
|---|
| 23 | 23 | | Subsection (e) to read as follows: |
|---|
| 24 | 24 | | (e) Notwithstanding Subsection (b)(6), the board may |
|---|
| 25 | 25 | | provide financial assistance under this subchapter to a political |
|---|
| 26 | 26 | | subdivision for a water supply or sewer service project that is |
|---|
| 27 | 27 | | located in an area in which the model rules adopted by the board |
|---|
| 28 | 28 | | under Section 16.343 are not enforced if the community to be served |
|---|
| 29 | 29 | | by the project was developed before the model rules were adopted by |
|---|
| 30 | 30 | | the board under that section. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
