77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to applicability of reporting requirements to private
1010 schools and other entities providing education services in this
1111 state that accept students with vouchers, education savings
1212 accounts, tax credit scholarships, or certain other funding.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 1, Education Code, is amended by adding
1515 Section 1.0026 to read as follows:
1616 Sec. 1.0026. APPLICATION OF REPORTING REQUIREMENTS TO
1717 CERTAIN PRIVATE SCHOOLS AND OTHER ENTITIES PROVIDING EDUCATION
1818 SERVICES IN THIS STATE. (a) In this section, "private school" has
1919 the meaning assigned by Section 5.001.
2020 (b) A private school or other entity providing education
2121 services in this state that accepts a student with a voucher,
2222 education savings account, tax credit scholarship, or any other
2323 funding that would otherwise have been part of the foundation
2424 school fund is subject to any reporting requirement that applies to
2525 a school district, the board of trustees of a school district, or
2626 public school students, including requirements imposed by a state
2727 agency or entity other than the agency. A private school or other
2828 entity subject to reporting requirements under this subsection
2929 shall provide a report required in accordance with this section not
3030 later than the 30th day after the date on which a public school must
3131 provide the same report.
3232 (c) A private school or other entity providing education
3333 services in this state may not enroll or otherwise provide
3434 education services to students described by Subsection (b) in any
3535 school year in which the private school or other entity providing
3636 education services does not comply with this section.
3737 SECTION 2. This Act applies beginning with the 2025-2026
3838 school year.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
