| 12 | 12 | | accounts, tax credit scholarships, or certain other funding. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Chapter 1, Education Code, is amended by adding |
|---|
| 15 | 15 | | Section 1.0026 to read as follows: |
|---|
| 16 | 16 | | Sec. 1.0026. APPLICATION OF REPORTING REQUIREMENTS TO |
|---|
| 17 | 17 | | CERTAIN PRIVATE SCHOOLS AND OTHER ENTITIES PROVIDING EDUCATION |
|---|
| 18 | 18 | | SERVICES IN THIS STATE. (a) In this section, "private school" has |
|---|
| 19 | 19 | | the meaning assigned by Section 5.001. |
|---|
| 20 | 20 | | (b) A private school or other entity providing education |
|---|
| 21 | 21 | | services in this state that accepts a student with a voucher, |
|---|
| 22 | 22 | | education savings account, tax credit scholarship, or any other |
|---|
| 23 | 23 | | funding that would otherwise have been part of the foundation |
|---|
| 24 | 24 | | school fund is subject to any reporting requirement that applies to |
|---|
| 25 | 25 | | a school district, the board of trustees of a school district, or |
|---|
| 26 | 26 | | public school students, including requirements imposed by a state |
|---|
| 27 | 27 | | agency or entity other than the agency. A private school or other |
|---|
| 28 | 28 | | entity subject to reporting requirements under this subsection |
|---|
| 29 | 29 | | shall provide a report required in accordance with this section not |
|---|
| 30 | 30 | | later than the 30th day after the date on which a public school must |
|---|
| 31 | 31 | | provide the same report. |
|---|
| 32 | 32 | | (c) A private school or other entity providing education |
|---|
| 33 | 33 | | services in this state may not enroll or otherwise provide |
|---|
| 34 | 34 | | education services to students described by Subsection (b) in any |
|---|
| 35 | 35 | | school year in which the private school or other entity providing |
|---|
| 36 | 36 | | education services does not comply with this section. |
|---|
| 37 | 37 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 38 | 38 | | school year. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2025. |
