11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 39.025(a-2), Education Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (a-2) The commissioner shall determine a method by which a |
---|
15 | 15 | | student's satisfactory performance on an advanced placement test, |
---|
16 | 16 | | an international baccalaureate examination, an SAT Subject Test, |
---|
17 | 17 | | the SAT, the ACT, or any nationally recognized norm-referenced |
---|
18 | 18 | | assessment instrument used by institutions of higher education to |
---|
19 | 19 | | award course credit based on satisfactory performance on the |
---|
20 | 20 | | assessment instrument shall be used to satisfy the requirements |
---|
21 | 21 | | concerning an end-of-course assessment instrument in an equivalent |
---|
22 | 22 | | course as prescribed by Subsection (a). The commissioner shall |
---|
23 | 23 | | determine a method by which a student's satisfactory performance on |
---|
24 | 24 | | the PSAT or the PreACT [ACT-Plan] shall be used to satisfy the |
---|
25 | 25 | | requirements concerning an end-of-course assessment instrument in |
---|
26 | 26 | | an equivalent course as prescribed by Subsection (a). A student who |
---|
27 | 27 | | fails to perform satisfactorily on a test or other assessment |
---|
28 | 28 | | instrument authorized under this subsection, other than the PSAT or |
---|
29 | 29 | | the PreACT [ACT-Plan], may retake that test or other assessment |
---|
30 | 30 | | instrument for purposes of this subsection or may take the |
---|
31 | 31 | | appropriate end-of-course assessment instrument. A student who |
---|
32 | 32 | | fails to perform satisfactorily on the PSAT or the PreACT |
---|
33 | 33 | | [ACT-Plan] must take the appropriate end-of-course assessment |
---|
34 | 34 | | instrument. The commissioner shall adopt rules as necessary for |
---|
35 | 35 | | the administration of this subsection. |
---|
36 | 36 | | SECTION 2. Section 39.0263(c), Education Code, is amended |
---|
37 | 37 | | to read as follows: |
---|
38 | 38 | | (c) The prohibition prescribed by this section does not |
---|
39 | 39 | | apply to the administration of a college preparation assessment |
---|
40 | 40 | | instrument, including the PSAT, the PreACT [ACT-Plan], the SAT, or |
---|
41 | 41 | | the ACT, an advanced placement test, an international baccalaureate |
---|
42 | 42 | | examination, or an independent classroom examination designed or |
---|
43 | 43 | | adopted and administered by a classroom teacher. |
---|
44 | 44 | | SECTION 3. Section 39.202, Education Code, is amended to |
---|
45 | 45 | | read as follows: |
---|
46 | 46 | | Sec. 39.202. ACADEMIC DISTINCTION DESIGNATION FOR |
---|
47 | 47 | | DISTRICTS AND CAMPUSES. The commissioner by rule shall establish |
---|
48 | 48 | | an academic distinction designation for districts and campuses for |
---|
49 | 49 | | outstanding performance in attainment of postsecondary readiness. |
---|
50 | 50 | | The commissioner shall adopt criteria for the designation under |
---|
51 | 51 | | this section, including: |
---|
52 | 52 | | (1) percentages of students who: |
---|
53 | 53 | | (A) performed satisfactorily, as determined |
---|
54 | 54 | | under the college readiness performance standard under Section |
---|
55 | 55 | | 39.0241, on assessment instruments required under Section |
---|
56 | 56 | | 39.023(a), (b), (c), or (l), aggregated across grade levels by |
---|
57 | 57 | | subject area; or |
---|
58 | 58 | | (B) met the standard for annual improvement, as |
---|
59 | 59 | | determined by the agency under Section 39.034, on assessment |
---|
60 | 60 | | instruments required under Section 39.023(a), (b), (c), or (l), |
---|
61 | 61 | | aggregated across grade levels by subject area, for students who |
---|
62 | 62 | | did not perform satisfactorily as described by Paragraph (A); |
---|
63 | 63 | | (2) percentages of: |
---|
64 | 64 | | (A) students who earned a nationally or |
---|
65 | 65 | | internationally recognized business or industry certification or |
---|
66 | 66 | | license; |
---|
67 | 67 | | (B) students who completed a coherent sequence of |
---|
68 | 68 | | career and technical courses; |
---|
69 | 69 | | (C) students who completed a dual credit course |
---|
70 | 70 | | or an articulated postsecondary course provided for local credit; |
---|
71 | 71 | | (D) students who achieved applicable College |
---|
72 | 72 | | Readiness Benchmarks or the equivalent on the Preliminary |
---|
73 | 73 | | Scholastic Assessment Test (PSAT), the Scholastic Assessment Test |
---|
74 | 74 | | (SAT), the American College Test (ACT), or the PreACT [ACT-Plan] |
---|
75 | 75 | | assessment program; and |
---|
76 | 76 | | (E) students who received a score on either an |
---|
77 | 77 | | advanced placement test or an international baccalaureate |
---|
78 | 78 | | examination to be awarded college credit; and |
---|
79 | 79 | | (3) other factors for determining sufficient student |
---|
80 | 80 | | attainment of postsecondary readiness. |
---|
81 | 81 | | SECTION 4. This Act takes effect immediately if it receives |
---|
82 | 82 | | a vote of two-thirds of all the members elected to each house, as |
---|
83 | 83 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
84 | 84 | | Act does not receive the vote necessary for immediate effect, this |
---|
85 | 85 | | Act takes effect September 1, 2025. |
