88 AN ACT
99 relating to the terminology used to refer to certain assessment
1010 instruments administered to public school students.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.025(a-2), Education Code, is amended
1313 to read as follows:
1414 (a-2) The commissioner shall determine a method by which a
1515 student's satisfactory performance on an advanced placement test,
1616 an international baccalaureate examination, an SAT Subject Test,
1717 the SAT, the ACT, or any nationally recognized norm-referenced
1818 assessment instrument used by institutions of higher education to
1919 award course credit based on satisfactory performance on the
2020 assessment instrument shall be used to satisfy the requirements
2121 concerning an end-of-course assessment instrument in an equivalent
2222 course as prescribed by Subsection (a). The commissioner shall
2323 determine a method by which a student's satisfactory performance on
2424 the PSAT or the PreACT [ACT-Plan] shall be used to satisfy the
2525 requirements concerning an end-of-course assessment instrument in
2626 an equivalent course as prescribed by Subsection (a). A student who
2727 fails to perform satisfactorily on a test or other assessment
2828 instrument authorized under this subsection, other than the PSAT or
2929 the PreACT [ACT-Plan], may retake that test or other assessment
3030 instrument for purposes of this subsection or may take the
3131 appropriate end-of-course assessment instrument. A student who
3232 fails to perform satisfactorily on the PSAT or the PreACT
3333 [ACT-Plan] must take the appropriate end-of-course assessment
3434 instrument. The commissioner shall adopt rules as necessary for
3535 the administration of this subsection.
3636 SECTION 2. Section 39.0263(c), Education Code, is amended
3737 to read as follows:
3838 (c) The prohibition prescribed by this section does not
3939 apply to the administration of a college preparation assessment
4040 instrument, including the PSAT, the PreACT [ACT-Plan], the SAT, or
4141 the ACT, an advanced placement test, an international baccalaureate
4242 examination, or an independent classroom examination designed or
4343 adopted and administered by a classroom teacher.
4444 SECTION 3. Section 39.202, Education Code, is amended to
4545 read as follows:
4646 Sec. 39.202. ACADEMIC DISTINCTION DESIGNATION FOR
4747 DISTRICTS AND CAMPUSES. The commissioner by rule shall establish
4848 an academic distinction designation for districts and campuses for
4949 outstanding performance in attainment of postsecondary readiness.
5050 The commissioner shall adopt criteria for the designation under
5151 this section, including:
5252 (1) percentages of students who:
5353 (A) performed satisfactorily, as determined
5454 under the college readiness performance standard under Section
5555 39.0241, on assessment instruments required under Section
5656 39.023(a), (b), (c), or (l), aggregated across grade levels by
5757 subject area; or
5858 (B) met the standard for annual improvement, as
5959 determined by the agency under Section 39.034, on assessment
6060 instruments required under Section 39.023(a), (b), (c), or (l),
6161 aggregated across grade levels by subject area, for students who
6262 did not perform satisfactorily as described by Paragraph (A);
6363 (2) percentages of:
6464 (A) students who earned a nationally or
6565 internationally recognized business or industry certification or
6666 license;
6767 (B) students who completed a coherent sequence of
6868 career and technical courses;
6969 (C) students who completed a dual credit course
7070 or an articulated postsecondary course provided for local credit;
7171 (D) students who achieved applicable College
7272 Readiness Benchmarks or the equivalent on the Preliminary
7373 Scholastic Assessment Test (PSAT), the Scholastic Assessment Test
7474 (SAT), the American College Test (ACT), or the PreACT [ACT-Plan]
7575 assessment program; and
7676 (E) students who received a score on either an
7777 advanced placement test or an international baccalaureate
7878 examination to be awarded college credit; and
7979 (3) other factors for determining sufficient student
8080 attainment of postsecondary readiness.
8181 SECTION 4. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2025.
