11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subtitle G, Title 3, Education Code, is amended |
---|
13 | 13 | | by adding Chapter 133A to read as follows: |
---|
14 | 14 | | CHAPTER 133A. APPRENTICESHIP TRAINING PROGRAM SPONSORSHIP FUND |
---|
15 | 15 | | Sec. 133A.001. DEFINITIONS. In this chapter: |
---|
16 | 16 | | (1) "Apprenticeship training program" has the meaning |
---|
17 | 17 | | assigned by Section 133.001. |
---|
18 | 18 | | (2) "Commission" means the Texas Workforce |
---|
19 | 19 | | Commission. |
---|
20 | 20 | | (3) "Fund" means the Apprenticeship Training Program |
---|
21 | 21 | | Sponsorship Fund established under this chapter. |
---|
22 | 22 | | Sec. 133A.002. APPRENTICESHIP TRAINING PROGRAM SPONSORSHIP |
---|
23 | 23 | | FUND. (a) The commission shall establish and administer the |
---|
24 | 24 | | Apprenticeship Training Program Sponsorship Fund as a dedicated |
---|
25 | 25 | | account in the general revenue fund. |
---|
26 | 26 | | (b) The following amounts shall be deposited in the fund: |
---|
27 | 27 | | (1) any money appropriated by the legislature for the |
---|
28 | 28 | | fund for purposes of this chapter; |
---|
29 | 29 | | (2) interest earned on the investment of money in the |
---|
30 | 30 | | fund; and |
---|
31 | 31 | | (3) gifts, grants, and donations received for the |
---|
32 | 32 | | fund. |
---|
33 | 33 | | Sec. 133A.003. FUND PURPOSE. The purpose of the fund is to |
---|
34 | 34 | | provide one-time grants to facilitate and support the development |
---|
35 | 35 | | of sponsors for apprenticeship training programs. |
---|
36 | 36 | | Sec. 133A.004. ADVISORY BOARD. (a) An advisory board of |
---|
37 | 37 | | education and workforce development stakeholders is created to |
---|
38 | 38 | | assist the commission in administering this chapter. |
---|
39 | 39 | | (b) The advisory board is composed of six members who serve |
---|
40 | 40 | | two-year terms and are appointed as follows: |
---|
41 | 41 | | (1) one member appointed by the governor; |
---|
42 | 42 | | (2) one member appointed by the lieutenant governor; |
---|
43 | 43 | | (3) one member appointed by the speaker of the house of |
---|
44 | 44 | | representatives; |
---|
45 | 45 | | (4) one member appointed by the Texas Higher Education |
---|
46 | 46 | | Coordinating Board; |
---|
47 | 47 | | (5) one member appointed by the commission; and |
---|
48 | 48 | | (6) the chair of the commission, who serves as the |
---|
49 | 49 | | presiding officer. |
---|
50 | 50 | | (c) The advisory board shall meet at least twice each |
---|
51 | 51 | | calendar year, or as needed, to make recommendations on awarding |
---|
52 | 52 | | grants under this chapter. |
---|
53 | 53 | | Sec. 133A.005. FUND USE. Money in the fund may be used by |
---|
54 | 54 | | the commission only to award grants as provided by Section |
---|
55 | 55 | | 133A.006. |
---|
56 | 56 | | Sec. 133A.006. GRANTS. (a) The commission shall award |
---|
57 | 57 | | one-time grants to eligible entities that apply to the commission |
---|
58 | 58 | | in the manner prescribed by commission rule and satisfy the |
---|
59 | 59 | | eligibility criteria prescribed by Section 133A.007. |
---|
60 | 60 | | (b) The commission shall award grants under this section on |
---|
61 | 61 | | the advice and recommendation of the advisory board established |
---|
62 | 62 | | under Section 133A.004. |
---|
63 | 63 | | Sec. 133A.007. GRANT ELIGIBILITY. To be eligible to |
---|
64 | 64 | | receive a grant under this chapter, an entity must facilitate the |
---|
65 | 65 | | employment of apprentices in this state by managing and |
---|
66 | 66 | | administering an apprenticeship training program as a sponsor for |
---|
67 | 67 | | the program, as recognized by the United States Department of |
---|
68 | 68 | | Labor. |
---|
69 | 69 | | Sec. 133A.008. GRANT USE. Money received by an entity under |
---|
70 | 70 | | this chapter may be used only for expenses related to managing and |
---|
71 | 71 | | administering an apprenticeship training program as a sponsor for |
---|
72 | 72 | | the program. |
---|
73 | 73 | | Sec. 133A.009. PERFORMANCE BENCHMARKS. (a) The commission |
---|
74 | 74 | | by rule shall establish performance benchmarks for entities |
---|
75 | 75 | | receiving grants under this chapter. |
---|
76 | 76 | | (b) The commission by rule shall require reimbursement on a |
---|
77 | 77 | | pro rata basis by an entity that does not meet a performance |
---|
78 | 78 | | benchmark required by this section. |
---|
79 | 79 | | (c) An entity is not required to comply with a performance |
---|
80 | 80 | | benchmark required by this section if the entity's compliance is |
---|
81 | 81 | | not possible because of an act of God, force majeure, or a similar |
---|
82 | 82 | | cause not reasonably within the entity's control. |
---|
83 | 83 | | Sec. 133A.010. REPORT. Not later than October 1 of each |
---|
84 | 84 | | even-numbered year, the commission shall submit to each standing |
---|
85 | 85 | | committee of the legislature with primary jurisdiction over higher |
---|
86 | 86 | | education or workforce development a report on grants awarded from |
---|
87 | 87 | | the fund during the most recent state fiscal year and the |
---|
88 | 88 | | effectiveness of the fund in facilitating and supporting the |
---|
89 | 89 | | development of sponsors for apprenticeship training programs. |
---|
90 | 90 | | Sec. 133A.011. RULES. The commission shall adopt rules as |
---|
91 | 91 | | necessary for the administration of this chapter. |
---|
92 | 92 | | SECTION 2. The Texas Workforce Commission shall adopt rules |
---|
93 | 93 | | for the administration of Chapter 133A, Education Code, as added by |
---|
94 | 94 | | this Act, as soon as practicable after the effective date of this |
---|
95 | 95 | | Act. |
---|
96 | 96 | | SECTION 3. This Act takes effect September 1, 2025. |
