88 AN ACT
99 relating to the establishment of the Apprenticeship Training
1010 Program Sponsorship Fund.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle G, Title 3, Education Code, is amended
1313 by adding Chapter 133A to read as follows:
1414 CHAPTER 133A. APPRENTICESHIP TRAINING PROGRAM SPONSORSHIP FUND
1515 Sec. 133A.001. DEFINITIONS. In this chapter:
1616 (1) "Apprenticeship training program" has the meaning
1717 assigned by Section 133.001.
1818 (2) "Commission" means the Texas Workforce
1919 Commission.
2020 (3) "Fund" means the Apprenticeship Training Program
2121 Sponsorship Fund established under this chapter.
2222 Sec. 133A.002. APPRENTICESHIP TRAINING PROGRAM SPONSORSHIP
2323 FUND. (a) The commission shall establish and administer the
2424 Apprenticeship Training Program Sponsorship Fund as a dedicated
2525 account in the general revenue fund.
2626 (b) The following amounts shall be deposited in the fund:
2727 (1) any money appropriated by the legislature for the
2828 fund for purposes of this chapter;
2929 (2) interest earned on the investment of money in the
3030 fund; and
3131 (3) gifts, grants, and donations received for the
3232 fund.
3333 Sec. 133A.003. FUND PURPOSE. The purpose of the fund is to
3434 provide one-time grants to facilitate and support the development
3535 of sponsors for apprenticeship training programs.
3636 Sec. 133A.004. ADVISORY BOARD. (a) An advisory board of
3737 education and workforce development stakeholders is created to
3838 assist the commission in administering this chapter.
3939 (b) The advisory board is composed of six members who serve
4040 two-year terms and are appointed as follows:
4141 (1) one member appointed by the governor;
4242 (2) one member appointed by the lieutenant governor;
4343 (3) one member appointed by the speaker of the house of
4444 representatives;
4545 (4) one member appointed by the Texas Higher Education
4646 Coordinating Board;
4747 (5) one member appointed by the commission; and
4848 (6) the chair of the commission, who serves as the
4949 presiding officer.
5050 (c) The advisory board shall meet at least twice each
5151 calendar year, or as needed, to make recommendations on awarding
5252 grants under this chapter.
5353 Sec. 133A.005. FUND USE. Money in the fund may be used by
5454 the commission only to award grants as provided by Section
5555 133A.006.
5656 Sec. 133A.006. GRANTS. (a) The commission shall award
5757 one-time grants to eligible entities that apply to the commission
5858 in the manner prescribed by commission rule and satisfy the
5959 eligibility criteria prescribed by Section 133A.007.
6060 (b) The commission shall award grants under this section on
6161 the advice and recommendation of the advisory board established
6262 under Section 133A.004.
6363 Sec. 133A.007. GRANT ELIGIBILITY. To be eligible to
6464 receive a grant under this chapter, an entity must facilitate the
6565 employment of apprentices in this state by managing and
6666 administering an apprenticeship training program as a sponsor for
6767 the program, as recognized by the United States Department of
6868 Labor.
6969 Sec. 133A.008. GRANT USE. Money received by an entity under
7070 this chapter may be used only for expenses related to managing and
7171 administering an apprenticeship training program as a sponsor for
7272 the program.
7373 Sec. 133A.009. PERFORMANCE BENCHMARKS. (a) The commission
7474 by rule shall establish performance benchmarks for entities
7575 receiving grants under this chapter.
7676 (b) The commission by rule shall require reimbursement on a
7777 pro rata basis by an entity that does not meet a performance
7878 benchmark required by this section.
7979 (c) An entity is not required to comply with a performance
8080 benchmark required by this section if the entity's compliance is
8181 not possible because of an act of God, force majeure, or a similar
8282 cause not reasonably within the entity's control.
8383 Sec. 133A.010. REPORT. Not later than October 1 of each
8484 even-numbered year, the commission shall submit to each standing
8585 committee of the legislature with primary jurisdiction over higher
8686 education or workforce development a report on grants awarded from
8787 the fund during the most recent state fiscal year and the
8888 effectiveness of the fund in facilitating and supporting the
8989 development of sponsors for apprenticeship training programs.
9090 Sec. 133A.011. RULES. The commission shall adopt rules as
9191 necessary for the administration of this chapter.
9292 SECTION 2. The Texas Workforce Commission shall adopt rules
9393 for the administration of Chapter 133A, Education Code, as added by
9494 this Act, as soon as practicable after the effective date of this
9595 Act.
9696 SECTION 3. This Act takes effect September 1, 2025.
