810 AN ACT
911 relating to the confidentiality and disclosure of certain financial
1012 information of perpetual care cemeteries and perpetual care trust
1113 funds.
1214 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1315 SECTION 1. Subchapter A, Chapter 712, Health and Safety
1416 Code, is amended by adding Section 712.010 to read as follows:
1517 Sec. 712.010. CONFIDENTIALITY AND DISCLOSURE OF CERTAIN
1618 INFORMATION. (a) Information relating to the financial condition
1719 of a perpetual care cemetery or fund the department obtains
1820 directly or indirectly, through examination or otherwise, other
1921 than a published statement, is confidential.
2022 (b) A department file or record relating to the financial
2123 condition of a perpetual care cemetery or fund is confidential.
2224 (c) The commissioner may disclose information described by
2325 Subsection (a) or (b) to an agency, department, or instrumentality
2426 of this or another state or the United States if the commissioner
2527 determines disclosure is in the best interest of the public and
2628 necessary or proper to enforce the laws of this or another state or
2729 the United States.
2830 SECTION 2. This Act takes effect immediately if it receives
2931 a vote of two-thirds of all the members elected to each house, as
3032 provided by Section 39, Article III, Texas Constitution. If this
3133 Act does not receive the vote necessary for immediate effect, this
3234 Act takes effect September 1, 2025.
