12 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 15 | | SECTION 1. Subchapter A, Chapter 712, Health and Safety |
---|
14 | 16 | | Code, is amended by adding Section 712.010 to read as follows: |

15 | 17 | | Sec. 712.010. CONFIDENTIALITY AND DISCLOSURE OF CERTAIN |
---|
16 | 18 | | INFORMATION. (a) Information relating to the financial condition |
---|
17 | 19 | | of a perpetual care cemetery or fund the department obtains |
---|
18 | 20 | | directly or indirectly, through examination or otherwise, other |
---|
19 | 21 | | than a published statement, is confidential. |
---|
20 | 22 | | (b) A department file or record relating to the financial |
---|
21 | 23 | | condition of a perpetual care cemetery or fund is confidential. |
---|
22 | 24 | | (c) The commissioner may disclose information described by |
---|
23 | 25 | | Subsection (a) or (b) to an agency, department, or instrumentality |
---|
24 | 26 | | of this or another state or the United States if the commissioner |
---|
25 | 27 | | determines disclosure is in the best interest of the public and |
---|
26 | 28 | | necessary or proper to enforce the laws of this or another state or |
---|
27 | 29 | | the United States. |
---|
28 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 34 | | Act takes effect September 1, 2025. |
---|
