88 AN ACT
99 relating to a pilot program awarding grants for the provision of
1010 personalized treatment protocols for veterans diagnosed with
1111 post-traumatic stress disorder.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1414 amended by adding Chapter 49 to read as follows:
1515 CHAPTER 49. VETERANS PILOT PROGRAM TO PROVIDE POST-TRAUMATIC
1616 STRESS DISORDER TREATMENT
1717 Sec. 49.001. DEFINITIONS. In this chapter:
1818 (1) "Pilot program" means the pilot program
1919 established under this chapter.
2020 (2) "Veteran" means an individual who has served in:
2121 (A) an active or reserve component of the army,
2222 navy, air force, coast guard, or marine corps of the United States;
2323 or
2424 (B) the Texas National Guard, as defined by
2525 Section 431.001, Government Code.
2626 Sec. 49.002. ESTABLISHMENT AND OPERATION OF PILOT PROGRAM.
2727 (a) The commission, using available resources and in cooperation
2828 with a nonprofit veterans organization, shall establish and operate
2929 a pilot program to award grants for the provision of personalized
3030 treatment protocols to at least 250 veterans diagnosed with
3131 post-traumatic stress disorder, including treatment-resistant
3232 post-traumatic stress disorder.
3333 (b) A personalized treatment protocol provided to a veteran
3434 under the pilot program must be:
3535 (1) administered at the veteran's home; and
3636 (2) designed to reduce neuroinflammation and
3737 replenish deficient or insufficient brain chemistry to an optimal
3838 level.
3939 (c) The commission may award a grant under the pilot program
4040 only in accordance with a contract between the commission and a
4141 grant recipient. The contract must include provisions under which
4242 the commission is granted sufficient control to ensure the public
4343 purpose of providing treatment to veterans is accomplished and the
4444 state receives the return benefit.
4545 (d) The commission may accept gifts, grants, and donations
4646 to operate the pilot program.
4747 Sec. 49.003. RULES. The executive commissioner shall adopt
4848 rules to implement this chapter.
4949 Sec. 49.004. REPORT. Not later than October 1, 2030, the
5050 commission shall prepare and submit to the governor, the lieutenant
5151 governor, the speaker of the house of representatives, and the
5252 appropriate standing committees of the legislature a report that
5353 includes:
5454 (1) information on the number of veterans who were
5555 provided a personalized treatment protocol under the pilot program;
5656 and
5757 (2) an evaluation of the pilot program's
5858 effectiveness.
5959 Sec. 49.005. EXPIRATION. The pilot program concludes and
6060 this chapter expires September 1, 2031.
6161 SECTION 2. As soon as practicable after the effective date
6262 of this Act:
6363 (1) the executive commissioner of the Health and Human
6464 Services Commission shall adopt the rules necessary to implement
6565 Chapter 49, Health and Safety Code, as added by this Act; and
6666 (2) the Health and Human Services Commission shall
6767 establish and begin operating the pilot program under Chapter 49,
6868 Health and Safety Code, as added by this Act.
6969 SECTION 3. This Act takes effect September 1, 2025.
