88 AN ACT
99 relating to youth injury mitigation and information training for
1010 coaches and youth athletics personnel.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 13, Occupations Code, is
1313 amended by adding Chapter 2053 to read as follows:
1414 CHAPTER 2053. COACHES AND ATHLETICS PERSONNEL
1515 Sec. 2053.001. SHORT TITLE. This chapter may be cited as
1616 the Coach Safely Act.
1717 Sec. 2053.002. DEFINITIONS. In this chapter:
1818 (1) "Association" means an organization that
1919 administers or conducts high-risk youth athletics activities on
2020 property owned, leased, managed, or maintained by this state, an
2121 agent of this state, or a state agency or political subdivision of
2222 this state.
2323 (2) "Athletics personnel" means athletic directors
2424 and other persons actively involved in organizing, training, or
2525 coaching sports activities for youth who are younger than 15 years
2626 of age.
2727 (3) "Coach" means:
2828 (A) any individual, whether paid, unpaid,
2929 volunteer, or interim, who an association approves to organize,
3030 train, or supervise a youth athlete or team of youth athletes; or
3131 (B) if an individual the association approves is
3232 unavailable, an individual not approved by the association who is
3333 selected as a coach by a youth athlete or a team of youth athletes.
3434 (4) "High-risk youth athletics activities" means any
3535 organized sport with a significant possibility for a youth athlete
3636 participating in the sport to sustain a serious physical injury,
3737 including:
3838 (A) baseball;
3939 (B) basketball;
4040 (C) cheerleading;
4141 (D) field hockey;
4242 (E) football;
4343 (F) ice hockey;
4444 (G) lacrosse;
4545 (H) soccer; and
4646 (I) volleyball.
4747 (5) "Youth athlete" means an individual younger than
4848 15 years of age who participates in an organized sport.
4949 Sec. 2053.003. APPLICABILITY AND CONSTRUCTION OF CHAPTER.
5050 (a) This chapter does not apply to:
5151 (1) athletic trainers;
5252 (2) physicians licensed to practice medicine in this
5353 state;
5454 (3) nurses licensed to practice nursing in this state;
5555 (4) first responders; and
5656 (5) any other health care professionals with acute
5757 traumatic life support training.
5858 (b) This chapter does not:
5959 (1) eliminate the involvement of athletic trainers at
6060 youth athletic events; or
6161 (2) impose any additional liability on political
6262 subdivisions of this state.
6363 Sec. 2053.004. TRAINING POLICY; YOUTH INJURY MITIGATION AND
6464 INFORMATION COURSE. (a) A youth athletics association that
6565 sponsors or conducts sports training or high-risk youth athletics
6666 activities for youth athletes shall adopt a policy to require all
6767 the association's coaches and athletics personnel to complete, if
6868 available at no cost, a youth injury mitigation and information
6969 course on actions and measures to decrease the likelihood of a youth
7070 athlete sustaining a serious injury while engaged or participating
7171 in a high-risk youth athletics activity. The course may be online
7272 or in person and must be approved by the Department of State Health
7373 Services.
7474 (b) A youth injury mitigation and information course must
7575 provide information on:
7676 (1) emergency preparedness, planning, and rehearsal
7777 for traumatic injuries;
7878 (2) concussions and head trauma;
7979 (3) heat and extreme weather-related injury
8080 familiarization;
8181 (4) physical conditioning and training equipment
8282 usage; and
8383 (5) heart defects and abnormalities leading to sudden
8484 cardiac arrest and death.
8585 (c) A person required to complete a youth injury mitigation
8686 and information course under this section must:
8787 (1) complete the course not later than the 30th day
8888 following the date the person becomes actively engaged in or serves
8989 as a coach or member of the athletics personnel for an association;
9090 and
9191 (2) annually complete the course not later than the
9292 anniversary of the date the person became actively engaged in
9393 serving as a coach or member of the athletics personnel for an
9494 association.
9595 Sec. 2053.005. RECORDS OF COURSE COMPLETION. An
9696 association conducting a high-risk youth athletics activity or
9797 event that requires a coach or a member of the athletics personnel
9898 to complete a youth injury mitigation and information course under
9999 Section 2053.004 shall maintain a record of the individual's course
100100 completion during the period the person serves as a coach or member
101101 of the athletics personnel for that association.
102102 Sec. 2053.006. IMMUNITY FROM LIABILITY. A coach or member
103103 of the athletics personnel of an association is immune from civil
104104 liability for any injury sustained by a youth athlete as a result of
105105 participation in a high-risk youth athletics activity on
106106 establishing that the coach or member:
107107 (1) completed the injury mitigation and information
108108 course required under Section 2053.004; and
109109 (2) reasonably conformed their conduct to the safety
110110 techniques and methods identified in the course.
111111 SECTION 2. As soon as practicable after the effective date
112112 of this Act, the executive commissioner of the Health and Human
113113 Services Commission shall adopt the rules necessary to implement
114114 Chapter 2053, Occupations Code, as added by this Act.
115115 SECTION 3. This Act takes effect September 1, 2025.
