| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 157.265, Family Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (c-1) to read as follows: |
|---|
| 14 | 14 | | (c-1) Notwithstanding Subsections (a), (b), and (c), for |
|---|
| 15 | 15 | | delinquent child support owed by a child support obligor who is |
|---|
| 16 | 16 | | confined in local, state, or federal jail or prison, the interest |
|---|
| 17 | 17 | | rate on child support arrearages described by each of those |
|---|
| 18 | 18 | | subsections accrues at the rate of three percent simple interest |
|---|
| 19 | 19 | | per year from the date of the obligor's incarceration until the date |
|---|
| 20 | 20 | | the obligor is released from incarceration. |
|---|
| 21 | 21 | | SECTION 2. Section 157.265(c-1), Family Code, as added by |
|---|
| 22 | 22 | | this Act, applies only to the accrual of interest on child support |
|---|
| 23 | 23 | | arrearages owed by a child support obligor who is incarcerated on or |
|---|
| 24 | 24 | | after the effective date of this Act. The accrual of interest on |
|---|
| 25 | 25 | | child support arrearages owed by a child support obligor |
|---|
| 26 | 26 | | incarcerated before the effective date of this Act is governed by |
|---|
| 27 | 27 | | the law in effect immediately before the effective date of this Act, |
|---|
| 28 | 28 | | and the former law is continued in effect for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2025. |
