77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting the transfer of certain semiautomatic
1010 rifles to certain recipients; creating a criminal offense;
1111 increasing a criminal penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 46.06(a), (c), and (d), Penal Code, are
1414 amended to read as follows:
1515 (a) A person commits an offense if the person:
1616 (1) sells, rents, leases, loans, or gives a handgun to
1717 any person knowing that the person to whom the handgun is to be
1818 delivered intends to use it unlawfully or in the commission of an
1919 unlawful act;
2020 (2) intentionally or knowingly sells, rents, leases,
2121 or gives or offers to sell, rent, lease, or give:
2222 (A) to a [any] child younger than 18 years of age
2323 a [any firearm,] club, [or] location-restricted knife, or firearm
2424 other than a semiautomatic rifle described by Paragraph (B); or
2525 (B) to a person younger than 21 years of age a
2626 semiautomatic rifle that is capable of accepting a detachable
2727 magazine and that has a caliber greater than .22;
2828 (3) intentionally, knowingly, or recklessly sells a
2929 firearm or ammunition for a firearm to any person who is
3030 intoxicated;
3131 (4) knowingly sells a firearm or ammunition for a
3232 firearm to any person who has been convicted of a felony before the
3333 fifth anniversary of the later of the following dates:
3434 (A) the person's release from confinement
3535 following conviction of the felony; or
3636 (B) the person's release from supervision under
3737 community supervision, parole, or mandatory supervision following
3838 conviction of the felony;
3939 (5) sells, rents, leases, loans, or gives a handgun to
4040 any person knowing that an active protective order is directed to
4141 the person to whom the handgun is to be delivered;
4242 (6) knowingly purchases, rents, leases, or receives as
4343 a loan or gift from another a handgun while an active protective
4444 order is directed to the actor; or
4545 (7) while prohibited from possessing a firearm under
4646 state or federal law, knowingly makes a material false statement on
4747 a form that is:
4848 (A) required by state or federal law for the
4949 purchase, sale, or other transfer of a firearm; and
5050 (B) submitted to a firearms dealer licensed under
5151 18 U.S.C. Section 923.
5252 (c) It is an affirmative defense to prosecution under
5353 Subsection (a)(2)(A) [(a)(2)] that the transfer was to a minor
5454 whose parent or the person having legal custody of the minor had
5555 given written permission for the sale or, if the transfer was other
5656 than a sale, the parent or person having legal custody had given
5757 effective consent.
5858 (d) An offense under this section is a Class A misdemeanor,
5959 except that:
6060 (1) an offense under Subsection (a)(2)(A) [(a)(2)] is
6161 a state jail felony if the weapon that is the subject of the offense
6262 is a handgun; and
6363 (2) an offense under Subsection (a)(2)(B) or (a)(7) is
6464 a state jail felony.
6565 SECTION 2. The change in law made by this Act applies only
6666 to an offense committed on or after the effective date of this Act.
6767 An offense committed before the effective date of this Act is
6868 governed by the law in effect on the date the offense was committed,
6969 and the former law is continued in effect for that purpose. For
7070 purposes of this section, an offense was committed before the
7171 effective date of this Act if any element of the offense occurred
7272 before that date.
7373 SECTION 3. This Act takes effect September 1, 2025.
