88 AN ACT
99 relating to the collection and publication of affordable housing
1010 information by certain municipalities and the Texas Department of
1111 Housing and Community Affairs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 371.001(a), Local Government Code, is
1414 amended to read as follows:
1515 (a) The governing body of a municipality with a population
1616 of 1.3 million or less may appropriate from its general fund an
1717 amount not to exceed one percent of the general fund budget for that
1818 year for the purpose of:
1919 (1) advertising the municipality and promoting its
2020 growth and development; and
2121 (2) promoting awareness of affordable housing options
2222 in the municipality, including by promoting the database described
2323 by Section 373C.052.
2424 SECTION 2. Section 371.021(a), Local Government Code, is
2525 amended to read as follows:
2626 (a) The governing body of a general-law municipality may
2727 appropriate from its general fund an amount not to exceed five cents
2828 per $100 assessed valuation for the purpose of:
2929 (1) advertising the municipality and promoting its
3030 growth and development; and
3131 (2) promoting awareness of affordable housing options
3232 in the municipality, including by promoting the database described
3333 by Section 373C.052.
3434 SECTION 3. Subtitle A, Title 12, Local Government Code, is
3535 amended by adding Chapter 373C to read as follows:
3636 CHAPTER 373C. COLLECTION AND PUBLICATION OF INFORMATION ON
3737 AFFORDABLE HOUSING AVAILABILITY
3838 SUBCHAPTER A. GENERAL PROVISIONS
3939 Sec. 373C.001. DEFINITIONS. In this chapter:
4040 (1) "Affordable housing unit" means:
4141 (A) an income-restricted or income-based housing
4242 unit, including:
4343 (i) a housing unit that may be obtained with
4444 a voucher provided through the housing choice voucher program under
4545 Section 8, United States Housing Act of 1937 (42 U.S.C. Section
4646 1437f);
4747 (ii) a public housing unit;
4848 (iii) a permanent supportive housing unit
4949 provided through a program operated by the Health and Human
5050 Services Commission;
5151 (iv) a unit that is part of a
5252 service-enriched housing project described by Subchapter NN,
5353 Chapter 2306, Government Code; and
5454 (v) a unit provided through an affordable
5555 housing initiative operated by a municipality; and
5656 (B) a rental housing unit not described by
5757 Paragraph (A) for which rent is not more than 30 percent of the
5858 lowest household income quartile in a municipality.
5959 (2) "Department" means the Texas Department of Housing
6060 and Community Affairs.
6161 Sec. 373C.002. APPLICABILITY. (a) This chapter applies to
6262 a municipality qualified to receive federal grants under the
6363 community development block grant entitlement program authorized
6464 under Title 1 of the Housing and Community Development Act of 1974
6565 (42 U.S.C. Section 5301 et seq.).
6666 (b) A municipality not described by Subsection (a) may
6767 participate in the collection and publication of affordable housing
6868 information described by Subchapter B. A municipality that elects
6969 to participate is subject to the requirements of this chapter.
7070 SUBCHAPTER B. COLLECTION AND PUBLICATION OF INFORMATION
7171 Sec. 373C.051. ANNUAL MUNICIPAL SURVEY. (a) A
7272 municipality shall conduct an annual survey of all affordable
7373 housing units located in the municipality. The survey must collect
7474 the following information for each unit, as applicable:
7575 (1) the unit type;
7676 (2) the monthly rent;
7777 (3) the estimated monthly cost of basic utilities not
7878 included in the rent amount;
7979 (4) any eligibility requirement, including any
8080 average median income restriction;
8181 (5) the length of any waiting list;
8282 (6) each social service provided to a tenant,
8383 including a supportive service;
8484 (7) the distance to nearby essential services,
8585 including:
8686 (A) public transit stops;
8787 (B) public elementary and secondary schools;
8888 (C) community health centers;
8989 (D) emergency medical facilities;
9090 (E) public safety facilities, including fire
9191 departments or police stations;
9292 (F) community centers; and
9393 (G) food retailers providing grocery items and
9494 fresh produce;
9595 (8) the distance to public community spaces, including
9696 parks, sports facilities, and playgrounds; and
9797 (9) a telephone number, mailing address, and e-mail
9898 address for a prospective tenant to inquire about renting the unit.
9999 (b) A municipality may collect and use the information
100100 required to be collected by Subsection (a) from any available
101101 source, including information collected for a survey conducted by
102102 the municipality in a previous year, provided that the municipality
103103 verifies the information is current and accurate.
104104 (c) A municipality shall provide the information collected
105105 under this section to any state agency that requests the
106106 information.
107107 Sec. 373C.052. DATABASE OF AFFORDABLE HOUSING INFORMATION.
108108 (a) A municipality shall publish the information collected under
109109 Section 373C.051 in a searchable database on a publicly accessible
110110 Internet website and mobile application. The municipality must
111111 ensure that the database enables a person to:
112112 (1) search for an affordable housing unit using the
113113 characteristics described by Section 373C.051(a);
114114 (2) update the database in real time if the person is
115115 authorized by the municipality to do so; and
116116 (3) view the complete survey information collected
117117 under that subsection.
118118 (b) A municipality shall update the municipality's database
119119 described by Subsection (a) at least annually.
120120 Sec. 373C.053. TEXAS DEPARTMENT OF HOUSING AND COMMUNITY
121121 AFFAIRS POWERS AND DUTIES. (a) The department shall adopt rules
122122 necessary to implement and administer this subchapter, including
123123 rules on the collection, compilation, analysis, and publication of
124124 information on the availability and accessibility of affordable
125125 housing in this state.
126126 (b) The department shall publish reports on the
127127 availability and accessibility of affordable housing in this state
128128 using information collected by municipalities under this
129129 subchapter and other information available to the department.
130130 (c) The department may cooperate with any governmental or
131131 private entity to carry out the department's duties under this
132132 subchapter.
133133 (d) The department may use gifts, grants, donations, or
134134 money appropriated to the department to carry out the department's
135135 duties under this subchapter.
136136 SECTION 4. This Act takes effect September 1, 2025.
