| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 261.103, Family Code, is amended by | |
| 12 | 12 | amending Subsection (a) and adding Subsections (a-1) and (d) to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | (a) Except as otherwise provided by this section | |
| 15 | 15 | [Subsections (b) and (c)] and Section 261.405, a report shall be | |
| 16 | 16 | made to: | |
| 17 | 17 | (1) any local or state law enforcement agency; and | |
| 18 | 18 | (2) the department. | |
| 19 | 19 | (a-1) If the alleged abuse or neglect occurred in a facility | |
| 20 | 20 | operated, licensed, certified, or registered by a state agency, a | |
| 21 | 21 | report may be made to[; or | |
| 22 | 22 | [(3)] the state agency that operates, licenses, | |
| 23 | 23 | certifies, or registers the facility in which the alleged abuse or | |
| 24 | 24 | neglect occurred in addition to the entities listed under | |
| 25 | 25 | Subsection (a). | |
| 26 | 26 | (d) A report must be made to the Texas Education Agency in | |
| 27 | 27 | addition to the entities listed under Subsection (a) if the report | |
| 28 | 28 | is based on alleged or suspected abuse or neglect that occurred at a | |
| 29 | 29 | public school. | |
| 30 | 30 | SECTION 2. Section 261.103(c), Family Code, is repealed. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
