57 AN ACT
68 relating to the Texas Emissions Reduction Plan.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 386.051(b), Health and Safety Code, is
911 amended to read as follows:
1012 (b) Under the plan, the commission and the comptroller shall
1113 provide grants or other funding for:
1214 (1) the diesel emissions reduction incentive program
1315 established under Subchapter C, including for infrastructure
1416 projects established under that subchapter;
1517 (2) the motor vehicle purchase or lease incentive
1618 program established under Subchapter D;
1719 (3) the air quality research support program
1820 established under Chapter 387;
1921 (4) the clean school bus program established under
2022 Chapter 390;
2123 (5) the new technology implementation grant program
2224 established under Chapter 391;
2325 (6) the regional air monitoring program established
2426 under Section 386.252(a);
2527 (7) a health effects study as provided by Section
2628 386.252(a);
2729 (8) air quality planning activities as provided by
2830 Section 386.252(d);
2931 (9) a contract with the Energy Systems Laboratory at
3032 the Texas A&M Engineering Experiment Station for computation of
3133 creditable statewide emissions reductions as provided by Section
3234 386.252(a);
3335 (10) the Texas clean fleet program established under
3436 Chapter 392;
3537 (11) the Texas alternative fueling facilities program
3638 established under Chapter 393;
3739 (12) the Texas natural gas vehicle grant program
3840 established under Chapter 394;
3941 (13) other programs the commission may develop that
4042 lead to reduced emissions of nitrogen oxides, particulate matter,
4143 or volatile organic compounds in a nonattainment area or affected
4244 county;
4345 (14) other programs the commission may develop that
4446 support congestion mitigation to reduce mobile source ozone
4547 precursor emissions;
4648 (15) the seaport and rail yard areas emissions
4749 reduction program established under Subchapter D-1;
4850 (16) conducting research and other activities
4951 associated with making any necessary demonstrations to the United
5052 States Environmental Protection Agency to account for the impact of
5153 foreign emissions or an exceptional event;
5254 (17) studies of or pilot programs for incentives for
5355 port authorities located in nonattainment areas or affected
5456 counties as provided by Section 386.252(a);
5557 (18) [the governmental alternative fuel fleet grant
5658 program established under Chapter 395;]
5759 [(19)] remittance of funds to the state highway fund
5860 for use by the Texas Department of Transportation for congestion
5961 mitigation and air quality improvement projects in nonattainment
6062 areas and affected counties; and
6163 (19)[(20)] the Texas hydrogen infrastructure,
6264 vehicle, and equipment grant program established under Subchapter
6365 G.
6466 SECTION 2. Section 386.252(a), Health and Safety Code, is
6567 amended to read as follows:
6668 (a) Money in the fund and account may be used only to
6769 implement and administer programs established under the plan.
6870 Subject to the reallocation of funds by the commission under
6971 Subsection (h) and after remittance to the state highway fund under
7072 Subsection (a-1), money from the fund and account to be used for the
7173 programs under Section 386.051(b) shall initially be allocated as
7274 follows:
7375 (1) three [four] percent may be used for the clean
7476 school bus program under Chapter 390;
7577 (2) eight percent may be used for the new technology
7678 implementation grant program under Chapter 391, from which at least
7779 $1 million will be set aside for electricity storage projects
7880 related to renewable energy and not more than $8 million may be used
7981 for hydrogen infrastructure and vehicles;
8082 (3) six [five] percent may be used for the Texas clean
8183 fleet program under Chapter 392;
8284 (4) not more than $3 million may be used by the
8385 commission to fund a regional air monitoring program in commission
8486 Regions 3 and 4 to be implemented under the commission's oversight,
8587 including direction regarding the type, number, location, and
8688 operation of, and data validation practices for, monitors funded by
8789 the program through a regional nonprofit entity located in North
8890 Texas having representation from counties, municipalities, higher
8991 education institutions, and private sector interests across the
9092 area;
9193 (5) 7.5 percent may be used for the Texas natural gas
9294 vehicle grant program under Chapter 394;
9395 (6) not more than $6 million may be used for the Texas
9496 alternative fueling facilities program under Chapter 393[, of which
9597 a specified amount may be used for fueling stations to provide
9698 natural gas fuel, except that money may not be allocated for the
9799 Texas alternative fueling facilities program for the state fiscal
98100 year ending August 31, 2019];
99101 (7) not more than $750,000 may be used each year to
100102 support research related to air quality as provided by Chapter 387;
101103 (8) not more than $200,000 may be used for a health
102104 effects study;
103105 (9) at least $6 million but not more than 15 percent
104106 may be used by the commission for administrative costs, including
105107 all direct and indirect costs for administering the plan, costs for
106108 conducting outreach and education activities, and costs
107109 attributable to the review or approval of applications for
108110 marketable emissions reduction credits;
109111 (10) six percent may be used by the commission for the
110112 seaport and rail yard areas emissions reduction program established
111113 under Subchapter D-1;
112114 (11) 2.5 percent may be used for the light-duty motor
113115 vehicle purchase or lease incentive program established under
114116 Subchapter D;
115117 (12) not more than $500,000 may be used by the
116118 commission to contract with the Energy Systems Laboratory at the
117119 Texas A&M Engineering Experiment Station annually for the
118120 development and annual computation of creditable statewide
119121 emissions reductions obtained through wind and other renewable
120122 energy resources for the state implementation plan that are
121123 obtained through:
122124 (A) wind and other renewable energy resources;
123125 (B) energy efficiency programs administered by the
124126 Public Utility Commission of Texas or the State Energy Conservation
125127 Office; or
126128 (C) the implementation of advanced building energy
127129 codes; and
128130 (13) [ not more than $500,000 may be used for studies
129131 of or pilot programs for incentives for port authorities located in
130132 nonattainment areas or affected counties to encourage cargo
131133 movement that reduces emissions of nitrogen oxides and particulate
132134 matter; and
133135 (14)] the balance is to be used by the commission for
134136 the diesel emissions reduction incentive program under Subchapter C
135137 as determined by the commission.
136138 SECTION 5. Sec. 391.001, Health and Safety Code is amended
137139 to read as follows: DEFINITIONS. In this chapter:
138140 (1) "Best available control technology" has the
139141 meaning assigned by Section 169 of the federal Clean Air Act (42
140142 U.S.C. Section 7479(3)).
141143 (2) "Commission" means the Texas Commission on
142144 Environmental Quality.
143145 (3) "Facility" has the meaning assigned by Section
144146 382.003.
145147 (4) "Incremental cost" has the meaning assigned by
146148 Section 386.001.
147149 (5) "New technology" means emissions control
148150 technology that results in emissions reductions that exceed state
149151 or federal requirements in effect at the time of submission of a new
150152 technology implementation grant application.
151153 (6) "Stationary source" has the meaning assigned by
152154 Section 302 of the federal Clean Air Act (42 U.S.C. Section
153155 7602(z)).
154156 (7) "Hydrogen vehicle" means a motor vehicle that uses
155157 hydrogen to operate the vehicle, including through the use of
156158 hydrogen fuel cells or an internal combustion engine that runs on
157159 hydrogen.
158160 SECTION 6. Sec. 391.002(b), Health and Safety Code, is
159161 amended to read as follows:
160162 (b) Projects that may be considered for a grant under the
161163 program include:
162164 (1) advanced clean energy projects, as defined by
163165 Section 382.003;
164166 (2) new technology projects that reduce emissions of
165167 regulated pollutants from stationary sources;
166168 (3) new technology projects that reduce emissions from
167169 upstream and midstream oil and gas production, completions,
168170 gathering, storage, processing, and transmission activities
169171 through:
170172 (A) the replacement, repower, or retrofit of
171173 stationary compressor engines;
172174 (B) the installation of systems to reduce or
173175 eliminate the loss of gas, flaring of gas, or burning of gas using
174176 other combustion control devices; or
175177 (C) the installation of systems that reduce
176178 flaring emissions and other site emissions; [and]
177179 (4) electricity storage projects related to renewable
178180 energy, including projects to store electricity produced from wind
179181 and solar generation that provide efficient means of making the
180182 stored energy available during periods of peak energy use; and[.]
181183 (5) to encourage the adoption of hydrogen
182184 infrastructure and vehicles, including:
183185 (A) implementation of hydrogen infrastructure
184186 projects;
185187 (B) purchase or lease of on-road or non-road
186188 hydrogen vehicles;
187189 (C) replacement of on-road or non-road vehicles
188190 with newer on-road or non-road hydrogen vehicles;
189191 (D) use of hydrogen fuel; and
190192 (E) purchase or lease of hydrogen engines and
191193 heavy equipment.
192194 SECTION 1. Section 393.006(a), Health and Safety Code, is
193195 amended to read as follows:
194196 (a) Grants awarded under this chapter for a facility to
195197 provide alternative fuels other than natural gas may not exceed
196198 [the lesser of:
197199 [(1)] 50 percent of the sum of the actual eligible
198200 costs incurred by the grant recipient within deadlines established
199201 by the commission[; or
200202 [(2) $600,000].
201203 SECTION 2. The changes in law made by this Act apply only to
202204 a Texas emissions reduction plan grant awarded on or after the
203205 effective date of this Act. A grant awarded before the effective
204206 date of this Act is governed by the law in effect on the date the
205207 award was made, and the former law is continued in effect for that
206208 purpose.
207209 SECTION 3. This Act takes effect September 1, 2025.
