9 | 9 | | relating to the authority of a political subdivision to provide |

10 | 10 | | credits against impact fees to builders and developers for certain |
---|
11 | 11 | | water conservation and reuse projects. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter B, Chapter 395, Local Government |
---|
14 | 14 | | Code, is amended by adding Section 395.0231 to read as follows: |

15 | 15 | | Sec. 395.0231. CONSERVATION AND REUSE CREDITS AGAINST WATER |
---|
16 | 16 | | AND WASTEWATER FEES. (a) A political subdivision may provide a |
---|
17 | 17 | | credit against water and wastewater impact fees otherwise assessed |
---|
18 | 18 | | to a development to a builder or developer for the construction, |
---|
19 | 19 | | contribution, or dedication of an eligible facility, system, or |
---|
20 | 20 | | product that results in water reuse, conservation, or savings. |
---|
21 | 21 | | (b) A facility, system, or product eligible for a credit |
---|
22 | 22 | | under this section includes a facility, system, or product that: |
---|
23 | 23 | | (1) reduces per service unit water consumption, supply |
---|
24 | 24 | | requirements, or necessary treatment and distribution |
---|
25 | 25 | | infrastructure per service unit; |
---|
26 | 26 | | (2) decreases the need of wastewater collection and |
---|
27 | 27 | | treatment facilities per service unit; |
---|
28 | 28 | | (3) diminishes the demand for stormwater, drainage, |
---|
29 | 29 | | and flood control facilities per service unit; or |
---|
30 | 30 | | (4) integrates practices or technologies that achieve |
---|
31 | 31 | | water efficiency, reuse, or conservation performance that exceed |
---|
32 | 32 | | standard compliance requirements. |
---|
33 | 33 | | (c) A political subdivision that provides a credit under |
---|
34 | 34 | | this section shall establish procedures for: |
---|
35 | 35 | | (1) calculating and applying the credits in a fair and |
---|
36 | 36 | | consistent manner; and |
---|
37 | 37 | | (2) reviewing and approving credits under this |
---|
38 | 38 | | section. |
---|
39 | 39 | | SECTION 2. This Act takes effect September 1, 2025. |
