77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a political subdivision to provide
1010 credits against impact fees to builders and developers for certain
1111 water conservation and reuse projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 395, Local Government
1414 Code, is amended by adding Section 395.0231 to read as follows:
1515 Sec. 395.0231. CONSERVATION AND REUSE CREDITS AGAINST WATER
1616 AND WASTEWATER FEES. (a) A political subdivision may provide a
1717 credit against water and wastewater impact fees otherwise assessed
1818 to a development to a builder or developer for the construction,
1919 contribution, or dedication of an eligible facility, system, or
2020 product that results in water reuse, conservation, or savings.
2121 (b) A facility, system, or product eligible for a credit
2222 under this section includes a facility, system, or product that:
2323 (1) reduces per service unit water consumption, supply
2424 requirements, or necessary treatment and distribution
2525 infrastructure per service unit;
2626 (2) decreases the need of wastewater collection and
2727 treatment facilities per service unit;
2828 (3) diminishes the demand for stormwater, drainage,
2929 and flood control facilities per service unit; or
3030 (4) integrates practices or technologies that achieve
3131 water efficiency, reuse, or conservation performance that exceed
3232 standard compliance requirements.
3333 (c) A political subdivision that provides a credit under
3434 this section shall establish procedures for:
3535 (1) calculating and applying the credits in a fair and
3636 consistent manner; and
3737 (2) reviewing and approving credits under this
3838 section.
3939 SECTION 2. This Act takes effect September 1, 2025.
