46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the definition of firearm for purposes of certain
79 criminal offenses.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 46.01(3), Penal Code, is amended to read
1012 as follows:
1113 (3) "Firearm" means any device designed, made, or
1214 adapted to expel a projectile through a barrel by using the energy
1315 generated by an explosion or burning substance or any device
1416 readily convertible to that use. Firearm does not include:
1517 (A) a firearm that may have, as an integral part,
1618 a folding knife blade or other characteristics of weapons made
1719 illegal by this chapter and that is:
1820 (i) [(A)] an antique or curio firearm
1921 manufactured before 1899; or
2022 (ii) [(B)] a replica of an antique or curio
2123 firearm manufactured before 1899, but only if the replica does not
2224 use rim fire or center fire ammunition; or
2325 (B) a stun gun as defined by Section 38.14.
2426 SECTION 2. The change in law made by this Act applies only
2527 to an offense committed on or after the effective date of this Act.
2628 An offense committed before the effective date of this Act is
2729 governed by the law in effect on the date the offense was committed,
2830 and the former law is continued in effect for that purpose. For
2931 purposes of this section, an offense was committed before the
3032 effective date of this Act if any element of the offense occurred
3133 before that date.
3234 SECTION 3. This Act takes effect September 1, 2025.
