| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 15, Penal Code, is amended by adding |
|---|
| 12 | 12 | | Section 15.021 to read as follows: |
|---|
| 13 | 13 | | Sec. 15.021. CRIMINAL PURSUIT. (a) In this section, |
|---|
| 14 | 14 | | "criminal instrument" means anything that in the manner of its use |
|---|
| 15 | 15 | | or intended use is capable of effecting the commission of an |
|---|
| 16 | 16 | | offense. |
|---|
| 17 | 17 | | (b) A person commits an offense if, with the intent to |
|---|
| 18 | 18 | | commit an offense under Chapter 29, an offense under Section 30.04 |
|---|
| 19 | 19 | | involving theft, or an offense under Section 31.03, the person: |
|---|
| 20 | 20 | | (1) knowingly travels from a commercial business or |
|---|
| 21 | 21 | | financial institution, as defined by Section 201.101, Finance Code, |
|---|
| 22 | 22 | | on the same path or route as another person without substantially |
|---|
| 23 | 23 | | deviating from that path or route; |
|---|
| 24 | 24 | | (2) is a member of a criminal street gang, as defined |
|---|
| 25 | 25 | | by Section 71.01; and |
|---|
| 26 | 26 | | (3) is in possession of two or more criminal |
|---|
| 27 | 27 | | instruments. |
|---|
| 28 | 28 | | (c) An offense under this section is a felony of the third |
|---|
| 29 | 29 | | degree. |
|---|
| 30 | 30 | | (d) If conduct constituting an offense under this section |
|---|
| 31 | 31 | | also constitutes an offense under another section of this code, the |
|---|
| 32 | 32 | | actor may be prosecuted under either section or under both |
|---|
| 33 | 33 | | sections. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2025. |
