77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to creating the criminal offense of criminal pursuit.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 15, Penal Code, is amended by adding
1212 Section 15.021 to read as follows:
1313 Sec. 15.021. CRIMINAL PURSUIT. (a) In this section,
1414 "criminal instrument" means anything that in the manner of its use
1515 or intended use is capable of effecting the commission of an
1616 offense.
1717 (b) A person commits an offense if, with the intent to
1818 commit an offense under Chapter 29, an offense under Section 30.04
1919 involving theft, or an offense under Section 31.03, the person:
2020 (1) knowingly travels from a commercial business or
2121 financial institution, as defined by Section 201.101, Finance Code,
2222 on the same path or route as another person without substantially
2323 deviating from that path or route;
2424 (2) is a member of a criminal street gang, as defined
2525 by Section 71.01; and
2626 (3) is in possession of two or more criminal
2727 instruments.
2828 (c) An offense under this section is a felony of the third
2929 degree.
3030 (d) If conduct constituting an offense under this section
3131 also constitutes an offense under another section of this code, the
3232 actor may be prosecuted under either section or under both
3333 sections.
3434 SECTION 2. This Act takes effect September 1, 2025.
