77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of public school students who are children
1010 of certain public servants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 25.0344, Education Code, as added by
1313 Chapters 322 (H.B. 1959) and 583 (H.B. 2892), Acts of the 88th
1414 Legislature, Regular Session, 2023, is reenacted and amended to
1515 read as follows:
1616 Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF
1717 CERTAIN PUBLIC SERVANTS [PEACE OFFICERS] [SERVICEMEMBERS]. (a) In
1818 this section:
1919 (1) "Parent" includes a person standing in parental
2020 relation to a student.
2121 (2) "Peace [peace] officer" has the meaning assigned
2222 by Section 1701.001, Occupations Code.
2323 (3) [,] "Servicemember [servicemember]" means an
2424 active duty member of the armed forces of the United States, a
2525 reserve component of the armed forces of the United States, or the
2626 Texas National Guard.
2727 (b) On request of [a peace officer] [servicemember who is] a
2828 parent of [or person standing in parental relation to] a student,
2929 the board of trustees of a school district or the board's designee
3030 shall transfer the student to another district campus or to another
3131 school district under an agreement under Section 25.035, if the
3232 parent is:
3333 (1) a peace officer;
3434 (2) a servicemember; or
3535 (3) a judge or justice of a state or federal court in
3636 this state.
3737 (c) A transfer under this section must be to the campus or
3838 school district, as applicable, selected by the parent [peace
3939 officer] [servicemember] making the request.
4040 (d) A school district is not required to provide
4141 transportation to a student who transfers to another campus or
4242 school district under this section.
4343 SECTION 2. To the extent of any conflict, this Act prevails
4444 over another Act of the 89th Legislature, Regular Session, 2025,
4545 relating to nonsubstantive additions to and corrections in enacted
4646 codes.
4747 SECTION 3. This Act applies beginning with the 2025-2026
4848 school year.
4949 SECTION 4. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2025.
