| 9 | 9 | | relating to the transfer of public school students who are children |

| 10 | 10 | | of certain public servants. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 25.0344, Education Code, as added by |
|---|
| 13 | 13 | | Chapters 322 (H.B. 1959) and 583 (H.B. 2892), Acts of the 88th |
|---|
| 14 | 14 | | Legislature, Regular Session, 2023, is reenacted and amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF |
|---|
| 17 | 17 | | CERTAIN PUBLIC SERVANTS [PEACE OFFICERS] [SERVICEMEMBERS]. (a) In |
|---|
| 18 | 18 | | this section: |
|---|
| 19 | 19 | | (1) "Parent" includes a person standing in parental |
|---|
| 20 | 20 | | relation to a student. |
|---|
| 21 | 21 | | (2) "Peace [peace] officer" has the meaning assigned |
|---|
| 22 | 22 | | by Section 1701.001, Occupations Code. |
|---|
| 23 | 23 | | (3) [,] "Servicemember [servicemember]" means an |
|---|
| 24 | 24 | | active duty member of the armed forces of the United States, a |
|---|
| 25 | 25 | | reserve component of the armed forces of the United States, or the |
|---|
| 26 | 26 | | Texas National Guard. |
|---|
| 27 | 27 | | (b) On request of [a peace officer] [servicemember who is] a |
|---|
| 28 | 28 | | parent of [or person standing in parental relation to] a student, |
|---|
| 29 | 29 | | the board of trustees of a school district or the board's designee |
|---|
| 30 | 30 | | shall transfer the student to another district campus or to another |
|---|
| 31 | 31 | | school district under an agreement under Section 25.035, if the |
|---|
| 32 | 32 | | parent is: |
|---|
| 33 | 33 | | (1) a peace officer; |
|---|
| 34 | 34 | | (2) a servicemember; or |
|---|
| 35 | 35 | | (3) a judge or justice of a state or federal court in |
|---|
| 36 | 36 | | this state. |
|---|
| 37 | 37 | | (c) A transfer under this section must be to the campus or |
|---|
| 38 | 38 | | school district, as applicable, selected by the parent [peace |
|---|
| 39 | 39 | | officer] [servicemember] making the request. |
|---|
| 40 | 40 | | (d) A school district is not required to provide |
|---|
| 41 | 41 | | transportation to a student who transfers to another campus or |
|---|
| 42 | 42 | | school district under this section. |
|---|
| 43 | 43 | | SECTION 2. To the extent of any conflict, this Act prevails |
|---|
| 44 | 44 | | over another Act of the 89th Legislature, Regular Session, 2025, |
|---|
| 45 | 45 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 46 | 46 | | codes. |
|---|
| 47 | 47 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 48 | 48 | | school year. |
|---|
| 49 | 49 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2025. |
