11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 828.013, Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | Sec. 828.013. EXEMPTIONS. This chapter does not apply to: | |
15 | 15 | (1) a dog or cat that is claimed from a releasing | |
16 | 16 | agency by a person who already owns the animal; | |
17 | 17 | (2) subject to Subdivision (5), a releasing agency | |
18 | 18 | located in a municipality that has in effect an ordinance providing | |
19 | 19 | standards for dog and cat sterilization that exceed the | |
20 | 20 | requirements provided by this chapter; | |
21 | 21 | (3) an institution of higher education that purchases | |
22 | 22 | or otherwise procures a dog or cat for the purpose of biomedical | |
23 | 23 | research, testing, or teaching; [or] | |
24 | 24 | (4) a releasing agency located in: | |
25 | 25 | (A) a county with a population of 20,000 or less; | |
26 | 26 | or | |
27 | 27 | (B) a municipality with a population of 10,000 or | |
28 | 28 | less; or | |
29 | 29 | (5) a dog or cat scheduled for euthanasia by the | |
30 | 30 | releasing agency that a new owner adopts. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
