| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 67, Water Code, is amended |
|---|
| 13 | 13 | | by adding Section 67.0115 to read as follows: |
|---|
| 14 | 14 | | Sec. 67.0115. ELECTRIC GENERATION. (a) A corporation |
|---|
| 15 | 15 | | operating in ERCOT, as defined by Section 31.002, Utilities Code, |
|---|
| 16 | 16 | | may register as a power generation company under Section 39.351, |
|---|
| 17 | 17 | | Utilities Code. |
|---|
| 18 | 18 | | (b) A corporation registered as a power generation company |
|---|
| 19 | 19 | | may generate electric power for sale in the ERCOT power region to |
|---|
| 20 | 20 | | provide revenue for the corporation. The revenue that accrues from |
|---|
| 21 | 21 | | the sale of electric power may be used by the corporation only for: |
|---|
| 22 | 22 | | (1) the corporation's costs of producing and selling |
|---|
| 23 | 23 | | electric power, including administration, employees, equipment, |
|---|
| 24 | 24 | | fuel, and maintenance; or |
|---|
| 25 | 25 | | (2) a purpose described by Section 67.002. |
|---|
| 26 | 26 | | (c) A corporation that generates electric power for sale |
|---|
| 27 | 27 | | shall account for and use the revenue from those sales in a manner |
|---|
| 28 | 28 | | that complies with Section 67.004. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2025. |
