| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Chapter 240, Local Government Code, is amended | |
| 13 | 13 | by adding Subchapter D to read as follows: | |
| 14 | 14 | SUBCHAPTER D. REGULATION OF NOISE LEVELS IN CERTAIN COUNTIES | |
| 15 | 15 | Sec. 240.061. AUTHORITY TO REGULATE. (a) To promote public | |
| 16 | 16 | health, safety, and welfare, the commissioners court of a county | |
| 17 | 17 | with a population of 250,000 or less by order may regulate the level | |
| 18 | 18 | of noise emanating from a property at night located in a residential | |
| 19 | 19 | area in the unincorporated area of the county. | |
| 20 | 20 | (b) This section does not authorize the commissioners court | |
| 21 | 21 | of a county to regulate the use of: | |
| 22 | 22 | (1) firearms; or | |
| 23 | 23 | (2) fireworks. | |
| 24 | 24 | Sec. 240.062. CRIMINAL OFFENSE. (a) A person commits an | |
| 25 | 25 | offense if the person violates an order adopted under Section | |
| 26 | 26 | 240.061 and the order defines the violation as an offense. | |
| 27 | 27 | (b) An offense under this section is a Class C misdemeanor. | |
| 28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
