77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to coverage for maternal depression screenings under
1010 Medicaid and the child health plan program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 62.1511(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) The covered services under the child health plan must
1515 include up to four [a] maternal depression screenings [screening]
1616 for an enrollee's mother, regardless of whether the mother is also
1717 an enrollee, that are [is] performed during a covered well-child or
1818 other office visit for the enrollee that occurs before the
1919 enrollee's first birthday.
2020 SECTION 2. Section 32.0561(b), Human Resources Code, is
2121 amended to read as follows:
2222 (b) The commission shall provide medical assistance
2323 reimbursement for up to four [a] maternal depression screenings
2424 [screening] for a recipient's mother, regardless of whether the
2525 mother is also a recipient, that are [is] performed during a covered
2626 examination for the recipient under the Texas Health Steps
2727 Comprehensive Care Program that occurs before the recipient's first
2828 birthday.
2929 SECTION 3. If before implementing any provision of this Act
3030 a state agency determines that a waiver or authorization from a
3131 federal agency is necessary for implementation of that provision,
3232 the agency affected by the provision shall request the waiver or
3333 authorization and may delay implementing that provision until the
3434 waiver or authorization is granted.
3535 SECTION 4. This Act takes effect September 1, 2025.
