77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the open carrying of a handgun by a uniformed school
1010 marshal.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 37.0811(c) and (d), Education Code, are
1313 amended to read as follows:
1414 (c) A school marshal appointed by the board of trustees of a
1515 school district or the governing body of an open-enrollment charter
1616 school may carry [a concealed handgun] or possess a handgun on the
1717 physical premises of a school, but only:
1818 (1) in the manner provided by written regulations
1919 adopted by the board of trustees or the governing body; and
2020 (2) at a specific school as specified by the board of
2121 trustees or governing body, as applicable.
2222 (d) Any written regulations adopted for purposes of
2323 Subsection (c) must:
2424 (1) provide that a school marshal may:
2525 (A) carry a concealed handgun on the school
2626 marshal's person;
2727 (B) if wearing a uniform identifying the marshal
2828 as a school marshal, openly carry a handgun on the school marshal's
2929 person; or
3030 (C) possess the handgun on the physical premises
3131 of a school in a locked and secured safe or other locked and secured
3232 location; and
3333 (2) [. The written regulations must also] require
3434 that a handgun carried or possessed by a school marshal [may] be
3535 loaded only with frangible duty ammunition approved for that
3636 purpose by the Texas Commission on Law Enforcement.
3737 SECTION 2. Sections 37.0813(c) and (d), Education Code, are
3838 amended to read as follows:
3939 (c) A school marshal appointed by the governing body of a
4040 private school may carry [a concealed handgun] or possess a handgun
4141 on the physical premises of a school, but only in the manner
4242 provided by written regulations adopted by the governing body.
4343 (d) Any written regulations adopted for purposes of
4444 Subsection (c) must:
4545 (1) provide that a school marshal may:
4646 (A) carry a concealed handgun on the school
4747 marshal's person;
4848 (B) if wearing a uniform identifying the marshal
4949 as a school marshal, openly carry a handgun on the school marshal's
5050 person; or
5151 (C) possess the handgun on the physical premises
5252 of a school in a locked and secured safe or other locked and secured
5353 location; and
5454 (2) [. The written regulations must also] require
5555 that a handgun carried or possessed by a school marshal [may] be
5656 loaded only with frangible duty ammunition approved for that
5757 purpose by the Texas Commission on Law Enforcement.
5858 SECTION 3. Section 51.220(d), Education Code, is amended to
5959 read as follows:
6060 (d) A school marshal appointed by the governing board of a
6161 public junior college may carry [a concealed handgun] or possess a
6262 handgun on the physical premises of a public junior college campus,
6363 but only:
6464 (1) in the manner provided by written regulations
6565 adopted by the governing board; and
6666 (2) at a specific public junior college campus as
6767 specified by the governing board.
6868 SECTION 4. Section 51.220(e), Education Code, as amended by
6969 Chapters 795 (H.B. 781) and 851 (S.B. 741), Acts of the 87th
7070 Legislature, Regular Session, 2021, is reenacted and amended to
7171 read as follows:
7272 (e) Any written regulations adopted for purposes of
7373 Subsection (d):
7474 (1) must [:
7575 [(A)] authorize a school marshal to:
7676 (A) carry a concealed handgun [as described by
7777 Subsection (d)] on the school marshal's person;
7878 (B) if wearing a uniform identifying the marshal
7979 as a school marshal, openly carry a handgun on the school marshal's
8080 person; or
8181 (C) possess the handgun on the physical premises
8282 of a public junior college campus in a locked and secured safe or
8383 other locked and secured location; [and]
8484 (2) must [(B)] require that a handgun carried or
8585 possessed by a school marshal [to] be loaded only with frangible
8686 duty ammunition approved for that purpose by the Texas Commission
8787 on Law Enforcement; and
8888 (3) [(2)] may not require a school marshal to store
8989 the handgun in a locked container while on duty.
9090 SECTION 5. This Act applies beginning with the 2025-2026
9191 school year.
9292 SECTION 6. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2025.
