77 AN ACT
88 relating to contested case hearings on the issuance, renewal, or
99 revocation of authorizations to use certain standard air quality
1010 permits.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.05195, Health and Safety Code, is
1313 amended by amending Subsection (g) and adding Subsection (g-1) to
1414 read as follows:
1515 (g) Except as provided by Subsection (g-1), the [The]
1616 adoption or amendment of a standard permit or the issuance,
1717 renewal, or revocation of an authorization to use a standard permit
1818 is not subject to Chapter 2001, Government Code.
1919 (g-1) A person may request a contested case hearing on the
2020 issuance, renewal, or revocation of an authorization to use a
2121 standard permit if the person alleges that the issuance, renewal,
2222 or revocation is in conflict with a provision of this chapter. A
2323 contested case hearing under this subsection is subject to the
2424 requirements of Subchapters C through G, Chapter 2001, Government
2525 Code, and Section 5.556, Water Code.
2626 SECTION 2. Section 382.05195(g-1), Health and Safety Code,
2727 as added by this Act, applies only to the issuance, renewal, or
2828 revocation of an authorization to use a standard permit the
2929 application for which is filed on or after the effective date of
3030 this Act. The issuance, renewal, or revocation of an authorization
3131 to use a standard permit the application for which was filed before
3232 the effective date of this Act is governed by the law in effect at
3333 the time the application was filed, and the former law is continued
3434 in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2025.
