11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 382.05195, Health and Safety Code, is |
---|
13 | 13 | | amended by amending Subsection (g) and adding Subsection (g-1) to |
---|
14 | 14 | | read as follows: |

15 | 15 | | (g) Except as provided by Subsection (g-1), the [The] |
---|
16 | 16 | | adoption or amendment of a standard permit or the issuance, |
---|
17 | 17 | | renewal, or revocation of an authorization to use a standard permit |
---|
18 | 18 | | is not subject to Chapter 2001, Government Code. |
---|
19 | 19 | | (g-1) A person may request a contested case hearing on the |
---|
20 | 20 | | issuance, renewal, or revocation of an authorization to use a |
---|
21 | 21 | | standard permit if the person alleges that the issuance, renewal, |
---|
22 | 22 | | or revocation is in conflict with a provision of this chapter. A |
---|
23 | 23 | | contested case hearing under this subsection is subject to the |
---|
24 | 24 | | requirements of Subchapters C through G, Chapter 2001, Government |
---|
25 | 25 | | Code, and Section 5.556, Water Code. |
---|
26 | 26 | | SECTION 2. Section 382.05195(g-1), Health and Safety Code, |
---|
27 | 27 | | as added by this Act, applies only to the issuance, renewal, or |
---|
28 | 28 | | revocation of an authorization to use a standard permit the |
---|
29 | 29 | | application for which is filed on or after the effective date of |
---|
30 | 30 | | this Act. The issuance, renewal, or revocation of an authorization |
---|
31 | 31 | | to use a standard permit the application for which was filed before |
---|
32 | 32 | | the effective date of this Act is governed by the law in effect at |
---|
33 | 33 | | the time the application was filed, and the former law is continued |
---|
34 | 34 | | in effect for that purpose. |
---|
35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
