| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 382.051955 to read as follows: |

| 13 | 13 | | Sec. 382.051955. STANDARD PERMIT FOR CONCRETE BATCH PLANTS: |
|---|
| 14 | 14 | | CONSIDERATION OF LOCAL GOVERNMENT ACTION BEFORE RENEWAL. (a) This |
|---|
| 15 | 15 | | section applies only to the renewal of an authorization to use a |
|---|
| 16 | 16 | | standard permit issued under Section 382.05195 for the operation of |
|---|
| 17 | 17 | | a permanent concrete plant that performs wet batching, dry |
|---|
| 18 | 18 | | batching, or central mixing. |
|---|
| 19 | 19 | | (b) In determining whether and under which conditions to |
|---|
| 20 | 20 | | renew an authorization described by Subsection (a), the commission |
|---|
| 21 | 21 | | shall, while classifying the applicant's compliance history under |
|---|
| 22 | 22 | | Section 5.754, Water Code, consider any civil suit instituted and |
|---|
| 23 | 23 | | any other enforcement actions taken by a local government against |
|---|
| 24 | 24 | | the applicant under Chapter 7, Water Code. |
|---|
| 25 | 25 | | SECTION 2. Section 382.051955, Health and Safety Code, as |
|---|
| 26 | 26 | | added by this Act, applies only to an application for a renewal of |
|---|
| 27 | 27 | | an authorization to use a standard permit that is submitted to the |
|---|
| 28 | 28 | | Texas Commission on Environmental Quality on or after the effective |
|---|
| 29 | 29 | | date of this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2025. |
