88 AN ACT
99 relating to student input for school district and campus
1010 improvement plans.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.251, Education Code, is amended by
1313 amending Subsections (b) and (g) and adding Subsection (b-1) to
1414 read as follows:
1515 (b) The board shall adopt a policy to establish a district-
1616 and campus-level planning and decision-making process that will
1717 involve the professional staff of the district, parents, students,
1818 and community members in establishing and reviewing the district's
1919 and campuses' educational plans, goals, performance objectives,
2020 and major classroom instructional programs. The board shall
2121 establish a procedure under which meetings are held regularly by
2222 district- and campus-level planning and decision-making committees
2323 that include representative professional staff, including, if
2424 practicable, at least one representative with the primary
2525 responsibility for educating students with disabilities, parents
2626 of students enrolled in the district, business representatives, and
2727 community members and that may include students enrolled in the
2828 district. The committees shall include a business representative
2929 without regard to whether the representative resides in the
3030 district or whether the business the person represents is located
3131 in the district. The board, or the board's designee, shall
3232 periodically meet with the district-level committee to review the
3333 district-level committee's deliberations.
3434 (b-1) The board shall adopt policies providing avenues for
3535 students to participate in the district- and campus-level planning
3636 and decision-making process, such as by inviting students to attend
3737 committee meetings or providing student input boxes at each campus
3838 through which a student may provide input anonymously.
3939 (g) This section does not:
4040 (1) prohibit the board from conducting meetings with
4141 teachers or groups of teachers other than the meetings described by
4242 this section;
4343 (2) prohibit the board from establishing policies
4444 providing avenues for input from others, including [students or]
4545 paraprofessional staff, in district- or campus-level planning and
4646 decision-making;
4747 (3) limit or affect the power of the board to govern
4848 the public schools; or
4949 (4) create a new cause of action or require collective
5050 bargaining.
5151 SECTION 2. Section 11.252, Education Code, is amended by
5252 adding Subsection (a-1) and amending Subsection (e) to read as
5353 follows:
5454 (a-1) A district improvement plan must identify the student
5555 input that was incorporated into the plan.
5656 (e) The district-level committee established under Section
5757 11.251 shall hold at least one public meeting per year. The
5858 required meeting shall be held after receipt of the annual district
5959 performance report from the agency for the purpose of discussing
6060 the performance of the district and the district performance
6161 objectives. District policy and procedures must be established to
6262 ensure that systematic communications measures are in place to
6363 periodically obtain broad-based community, parent, student, and
6464 staff input and to provide information to those persons regarding
6565 the recommendations of the district-level committee. This section
6666 does not create a new cause of action or require collective
6767 bargaining.
6868 SECTION 3. Sections 11.253(d) and (g), Education Code, are
6969 amended to read as follows:
7070 (d) Each campus improvement plan must:
7171 (1) assess the academic achievement for each student
7272 in the school using the achievement indicator system as described
7373 by Section 39.053;
7474 (2) set the campus performance objectives based on the
7575 achievement indicator system, including objectives for special
7676 needs populations, including students in special education
7777 programs under Subchapter A, Chapter 29;
7878 (3) identify how the campus goals will be met for each
7979 student;
8080 (4) determine the resources needed to implement the
8181 plan;
8282 (5) identify staff needed to implement the plan;
8383 (6) set timelines for reaching the goals;
8484 (7) measure progress toward the performance
8585 objectives periodically to ensure that the plan is resulting in
8686 academic improvement;
8787 (8) include goals and methods for violence prevention
8888 and intervention on campus;
8989 (9) provide for a program to encourage parental
9090 involvement at the campus; [and]
9191 (10) if the campus is an elementary, middle, or junior
9292 high school, set goals and objectives for the coordinated health
9393 program at the campus based on:
9494 (A) student fitness assessment data, including
9595 any data from research-based assessments such as the school health
9696 index assessment and planning tool created by the federal Centers
9797 for Disease Control and Prevention;
9898 (B) student academic performance data;
9999 (C) student attendance rates;
100100 (D) the percentage of students who are
101101 educationally disadvantaged;
102102 (E) the use and success of any method to ensure
103103 that students participate in moderate to vigorous physical activity
104104 as required by Section 28.002(l); and
105105 (F) any other indicator recommended by the local
106106 school health advisory council; and
107107 (11) identify the student input that was incorporated
108108 into the plan.
109109 (g) Each campus-level committee shall hold at least one
110110 public meeting per year. The required meeting shall be held after
111111 receipt of the annual campus rating from the agency to discuss the
112112 performance of the campus and the campus performance objectives.
113113 District policy and campus procedures must be established to ensure
114114 that systematic communications measures are in place to
115115 periodically obtain broad-based community, parent, student, and
116116 staff input, and to provide information to those persons regarding
117117 the recommendations of the campus-level committees.
118118 SECTION 4. This Act applies beginning with the 2025-2026
119119 school year.
120120 SECTION 5. This Act takes effect immediately if it receives
121121 a vote of two-thirds of all the members elected to each house, as
122122 provided by Section 39, Article III, Texas Constitution. If this
123123 Act does not receive the vote necessary for immediate effect, this
124124 Act takes effect September 1, 2025.
