77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to exceptions to and the repeal of certain laws
1010 prohibiting abortion.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 170A.002, Health and Safety Code, is
1313 amended by adding Subsection (b-1) to read as follows:
1414 (b-1) It is an exception to the application of Subsection
1515 (a) that the pregnant patient indicates the pregnancy resulted from
1616 sexual assault in violation of Section 22.011, Penal Code,
1717 aggravated sexual assault in violation of Section 22.021, Penal
1818 Code, or conduct constituting an offense under Section 25.02, Penal
1919 Code. This subsection may not be construed to require:
2020 (1) the pregnant patient to file a police or
2121 investigative report;
2222 (2) the pregnant patient to provide forensic evidence;
2323 or
2424 (3) prosecution of the alleged offense.
2525 SECTION 2. The heading to Section 171.205, Health and
2626 Safety Code, is amended to read as follows:
2727 Sec. 171.205. EXCEPTIONS [EXCEPTION FOR MEDICAL
2828 EMERGENCY]; RECORDS.
2929 SECTION 3. Section 171.205, Health and Safety Code, is
3030 amended by adding Subsection (a-1) to read as follows:
3131 (a-1) Sections 171.203 and 171.204 do not apply to an
3232 abortion performed or induced by a person in accordance with an
3333 exception provided by Section 170A.002.
3434 SECTION 4. Section 171.206(b), Health and Safety Code, is
3535 amended to read as follows:
3636 (b) This subchapter may not be construed to:
3737 (1) authorize the initiation of a cause of action
3838 against or the prosecution of a pregnant patient [woman] on whom an
3939 abortion is performed or induced or attempted to be performed or
4040 induced in violation of this subchapter;
4141 (2) wholly or partly repeal, either expressly or by
4242 implication, any other statute that regulates or prohibits
4343 abortion[, including Chapter 6-1/2, Title 71, Revised Statutes]; or
4444 (3) restrict a political subdivision from regulating
4545 or prohibiting abortion in a manner that is at least as stringent as
4646 the laws of this state.
4747 SECTION 5. Section 171.207(b), Health and Safety Code, is
4848 amended to read as follows:
4949 (b) Subsection (a) may not be construed to:
5050 (1) legalize the conduct prohibited by this subchapter
5151 [or by Chapter 6-1/2, Title 71, Revised Statutes];
5252 (2) limit in any way or affect the availability of a
5353 remedy established by Section 171.208; or
5454 (3) limit the enforceability of any other laws that
5555 regulate or prohibit abortion.
5656 SECTION 6. Chapter 6-1/2, Title 71, Revised Statutes, is
5757 repealed.
5858 SECTION 7. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2025.
