9 | 9 | | relating to tuition and fee exemptions at a public institution of |
---|
10 | 10 | | higher education or a career school or college for a student meeting |
---|
11 | 11 | | certain income and grade requirements. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter D, Chapter 54, Education Code, is |
---|
14 | 14 | | amended by adding Section 54.204 to read as follows: |
---|
15 | 15 | | Sec. 54.204. EXEMPTION FOR STUDENTS MEETING CERTAIN INCOME |
---|
16 | 16 | | AND GRADE REQUIREMENTS. (a) The governing board of an institution |
---|
17 | 17 | | of higher education shall exempt from the payment of tuition and |
---|
18 | 18 | | required fees charged by the institution an undergraduate student |
---|
19 | 19 | | who: |
---|
20 | 20 | | (1) is a resident of this state; |
---|
21 | 21 | | (2) is a member of a household with a total annual |
---|
22 | 22 | | income below $100,000; and |
---|
23 | 23 | | (3) maintains an overall grade point average of at |
---|
24 | 24 | | least 3.0 on a four-point scale or the equivalent for all coursework |
---|
25 | 25 | | attempted at the institution. |
---|
26 | 26 | | (b) The Texas Higher Education Coordinating Board shall |
---|
27 | 27 | | adopt rules governing the granting or denial of an exemption under |
---|
28 | 28 | | this section, including rules relating to the determination of a |
---|
29 | 29 | | student's eligibility for an exemption. |
---|
30 | 30 | | SECTION 2. Subchapter C, Chapter 132, Education Code, is |
---|
31 | 31 | | amended by adding Section 132.0612 to read as follows: |
---|
32 | 32 | | Sec. 132.0612. TUITION EXEMPTION FOR STUDENTS MEETING |
---|
33 | 33 | | CERTAIN INCOME AND GRADE REQUIREMENTS. As a condition to receiving |
---|
34 | 34 | | a certificate of approval under this chapter, including renewal of |
---|
35 | 35 | | a certificate of approval, a career school or college must provide |
---|
36 | 36 | | an exemption from the payment of tuition and required fees charged |
---|
37 | 37 | | by the school for a course or program, as applicable, to a student |
---|
38 | 38 | | who is exempt from the payment of tuition and fees at a public |
---|
39 | 39 | | institution of higher education as provided by Section 54.204. |
---|
40 | 40 | | SECTION 3. (a) The Texas Higher Education Coordinating |
---|
41 | 41 | | Board shall adopt the rules required by Section 54.204, Education |
---|
42 | 42 | | Code, as added by this Act, as soon as practicable after the |
---|
43 | 43 | | effective date of this Act. |
---|
44 | 44 | | (b) Section 54.204, Education Code, as added by this Act, |
---|
45 | 45 | | applies beginning with tuition and required fees charged for the |
---|
46 | 46 | | 2025 fall semester. Tuition and required fees charged for an |
---|
47 | 47 | | academic period before that semester are governed by the law in |
---|
48 | 48 | | effect immediately before the effective date of this Act, and the |
---|
49 | 49 | | former law is continued in effect for that purpose. |
---|
50 | 50 | | SECTION 4. Section 132.0612, Education Code, as added by |
---|
51 | 51 | | this Act, applies to a certificate of approval issued or renewed |
---|
52 | 52 | | under Chapter 132, Education Code, on or after the effective date of |
---|
53 | 53 | | this Act. |
---|
54 | 54 | | SECTION 5. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2025. |
