77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to tuition and fee exemptions at a public institution of
1010 higher education or a career school or college for a student meeting
1111 certain income and grade requirements.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 54, Education Code, is
1414 amended by adding Section 54.204 to read as follows:
1515 Sec. 54.204. EXEMPTION FOR STUDENTS MEETING CERTAIN INCOME
1616 AND GRADE REQUIREMENTS. (a) The governing board of an institution
1717 of higher education shall exempt from the payment of tuition and
1818 required fees charged by the institution an undergraduate student
1919 who:
2020 (1) is a resident of this state;
2121 (2) is a member of a household with a total annual
2222 income below $100,000; and
2323 (3) maintains an overall grade point average of at
2424 least 3.0 on a four-point scale or the equivalent for all coursework
2525 attempted at the institution.
2626 (b) The Texas Higher Education Coordinating Board shall
2727 adopt rules governing the granting or denial of an exemption under
2828 this section, including rules relating to the determination of a
2929 student's eligibility for an exemption.
3030 SECTION 2. Subchapter C, Chapter 132, Education Code, is
3131 amended by adding Section 132.0612 to read as follows:
3232 Sec. 132.0612. TUITION EXEMPTION FOR STUDENTS MEETING
3333 CERTAIN INCOME AND GRADE REQUIREMENTS. As a condition to receiving
3434 a certificate of approval under this chapter, including renewal of
3535 a certificate of approval, a career school or college must provide
3636 an exemption from the payment of tuition and required fees charged
3737 by the school for a course or program, as applicable, to a student
3838 who is exempt from the payment of tuition and fees at a public
3939 institution of higher education as provided by Section 54.204.
4040 SECTION 3. (a) The Texas Higher Education Coordinating
4141 Board shall adopt the rules required by Section 54.204, Education
4242 Code, as added by this Act, as soon as practicable after the
4343 effective date of this Act.
4444 (b) Section 54.204, Education Code, as added by this Act,
4545 applies beginning with tuition and required fees charged for the
4646 2025 fall semester. Tuition and required fees charged for an
4747 academic period before that semester are governed by the law in
4848 effect immediately before the effective date of this Act, and the
4949 former law is continued in effect for that purpose.
5050 SECTION 4. Section 132.0612, Education Code, as added by
5151 this Act, applies to a certificate of approval issued or renewed
5252 under Chapter 132, Education Code, on or after the effective date of
5353 this Act.
5454 SECTION 5. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2025.
