77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prohibition on the possession of a firearm by a
1010 person following the person's conviction of certain family violence
1111 misdemeanors.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 46.04(b), Penal Code, is amended to read
1414 as follows:
1515 (b) A person who has been convicted of an offense under
1616 Section 22.01, punishable as a [Class A] misdemeanor and committed
1717 against an individual whose relationship to or association with the
1818 person is described by Section 71.0021(b), 71.003, or 71.005,
1919 Family Code [involving a member of the person's family or
2020 household], commits an offense if the person possesses a firearm
2121 before the fifth anniversary of the later of:
2222 (1) the date of the person's release from confinement
2323 following conviction of the misdemeanor; or
2424 (2) the date of the person's release from community
2525 supervision following conviction of the misdemeanor.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an offense committed on or after the effective date of this Act.
2828 An offense committed before the effective date of this Act is
2929 governed by the law in effect on the date the offense was committed,
3030 and the former law is continued in effect for that purpose. For
3131 purposes of this section, an offense was committed before the
3232 effective date of this Act if any element of the offense was
3333 committed before that date.
3434 SECTION 3. This Act takes effect September 1, 2025.
