10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 43.0681, Local Government Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | Sec. 43.0681. AUTHORITY TO ANNEX. (a) Subject to | |
14 | 14 | Subsection (b), a [A] municipality may annex an area with a | |
15 | 15 | population of less than 200 only if the following conditions are | |
16 | 16 | met, as applicable: | |
17 | 17 | (1) the municipality obtains consent to annex the area | |
18 | 18 | through a petition signed by more than 50 percent of the registered | |
19 | 19 | voters of the area; and | |
20 | 20 | (2) if the registered voters of the area do not own | |
21 | 21 | more than 50 percent of the land in the area, the petition described | |
22 | 22 | by Subdivision (1) is signed by more than 50 percent of the owners | |
23 | 23 | of land in the area. | |
24 | 24 | (b) A municipality may only annex one area under this | |
25 | 25 | subchapter per calendar year. | |
26 | 26 | SECTION 2. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2025. |
