77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study by the office of the governor regarding the
1010 implementation in this state of the processes and methodologies
1111 used by the United States DOGE Service.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. DEFINITIONS. In this Act:
1414 (1) "Office" means the office of the governor.
1515 (2) "Service" means the United States DOGE Service
1616 established in the executive office of the president of the United
1717 States by Executive Order No. 14158 (2025).
1818 (3) "State agency" means a department, commission,
1919 board, office, council, authority, or other agency in the executive
2020 branch of state government that is created by the constitution or a
2121 statute of this state, including a university system or institution
2222 of higher education as defined by Section 61.003, Education Code.
2323 SECTION 2. STUDY ON IMPLEMENTATION OF CERTAIN EFFICIENCY
2424 PROCESSES AND METHODOLOGIES. (a) The office shall conduct a study
2525 to evaluate the feasibility and benefits of adopting the service's
2626 processes and methodologies for use in this state to identify and
2727 eliminate waste, fraud, and abuse at state agencies.
2828 (b) At a minimum, the study must:
2929 (1) analyze the service's methodologies, including
3030 data analytics, process improvement, and oversight mechanisms;
3131 (2) compare the existing practices of state agencies
3232 with the standards developed and used by the service to review
3333 federal agencies to identify discrepancies and areas for
3434 improvement at state agencies;
3535 (3) assess the potential cost savings, efficiency
3636 gains, and improvements in service delivery at state agencies if
3737 the service's processes and methodologies were adopted by this
3838 state;
3939 (4) make recommendations on how the service's
4040 processes and methodologies can be tailored to fit the legal,
4141 administrative, and cultural contexts of this state and the
4242 operations of state agencies; and
4343 (5) analyze the legal and constitutional
4444 considerations, if any, of adopting the service's processes and
4545 methodologies for use in this state.
4646 SECTION 3. REPORT. (a) The office shall prepare and submit
4747 a report to the lieutenant governor, the speaker of the house of
4848 representatives, and each other member of the legislature not later
4949 than December 1, 2026.
5050 (b) The report must include:
5151 (1) the findings of the study conduced under Section 2
5252 of this Act;
5353 (2) the office's recommendations regarding the
5454 implementation of the service's processes and methodologies in this
5555 state, including, if applicable, a timeline for implementation that
5656 may provide for the processes and methodologies to be phased in over
5757 time;
5858 (3) if appropriate, proposed legislation necessary to
5959 implement the service's processes and methodologies that the office
6060 recommends be adopted by this state; and
6161 (4) an estimate of resources required, including
6262 funding and personnel, to implement the service's processes and
6363 methodologies that the office recommends be adopted by this state.
6464 (c) The office shall publish the report in a publicly
6565 accessible location on the office's Internet website.
6666 SECTION 4. EXPIRATION. This Act expires September 1, 2027.
6767 SECTION 5. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2025.
