66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the carrying of handguns on the campuses of and certain
99 other locations associated with institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 411.2031(e), Government Code, is amended
1212 to read as follows:
1313 (e) An institution of higher education or [A] private or
1414 independent institution of higher education in this state, after
1515 consulting with students, staff, and faculty of the institution,
1616 may establish rules, regulations, or other provisions prohibiting
1717 license holders from carrying handguns on the campus of the
1818 institution, any grounds or building on which an activity sponsored
1919 by the institution is being conducted, or a passenger
2020 transportation vehicle owned by the institution.
2121 SECTION 2. Sections 411.208(a), (b), and (d), Government
2222 Code, are amended to read as follows:
2323 (a) A court may not hold the state, an agency or subdivision
2424 of the state, an officer or employee of the state, an institution of
2525 higher education[, an officer] or [employee of an institution of
2626 higher education, a] private or independent institution of higher
2727 education that has not adopted rules under Section 411.2031(e), an
2828 officer or employee of an institution of higher education or [a]
2929 private or independent institution of higher education that has not
3030 adopted rules under Section 411.2031(e), a peace officer, a
3131 qualified handgun instructor, or an approved online course provider
3232 liable for damages caused by:
3333 (1) an action authorized under this subchapter or a
3434 failure to perform a duty imposed by this subchapter; or
3535 (2) the actions of an applicant or license holder that
3636 occur after the applicant has received a license or been denied a
3737 license under this subchapter.
3838 (b) A cause of action in damages may not be brought against
3939 the state, an agency or subdivision of the state, an officer or
4040 employee of the state, an institution of higher education[, an
4141 officer] or [employee of an institution of higher education, a]
4242 private or independent institution of higher education that has not
4343 adopted rules under Section 411.2031(e), an officer or employee of
4444 an institution of higher education or [a] private or independent
4545 institution of higher education that has not adopted rules under
4646 Section 411.2031(e), a peace officer, a qualified handgun
4747 instructor, or an approved online course provider for any damage
4848 caused by the actions of an applicant or license holder under this
4949 subchapter.
5050 (d) The immunities granted under Subsections (a), (b), and
5151 (c) do not apply to:
5252 (1) an act or a failure to act by the state, an agency
5353 or subdivision of the state, an officer of the state, an institution
5454 of higher education[, an officer] or [employee of an institution of
5555 higher education, a] private or independent institution of higher
5656 education that has not adopted rules under Section 411.2031(e), an
5757 officer or employee of an institution of higher education or [a]
5858 private or independent institution of higher education that has not
5959 adopted rules under Section 411.2031(e), or a peace officer if the
6060 act or failure to act was capricious or arbitrary; or
6161 (2) any officer or employee of an institution of
6262 higher education or private or independent institution of higher
6363 education described by Subdivision (1) who possesses a handgun on
6464 the campus of that institution and whose conduct with regard to the
6565 handgun is made the basis of a claim for personal injury or property
6666 damage.
6767 SECTION 3. Section 46.03(a-3), Penal Code, is amended to
6868 read as follows:
6969 (a-3) Notwithstanding Subsection (a) or Section 46.02(a-5),
7070 a license holder commits an offense if the license holder carries a
7171 handgun on the campus of an institution of higher education or [a]
7272 private or independent institution of higher education in this
7373 state that has established rules, regulations, or other provisions
7474 prohibiting license holders from carrying handguns pursuant to
7575 Section 411.2031(e), Government Code, or on the grounds or building
7676 on which an activity sponsored by such an institution is being
7777 conducted, or in a passenger transportation vehicle of such an
7878 institution, regardless of whether the handgun is concealed,
7979 provided the institution gives effective notice under Section
8080 30.06.
8181 SECTION 4. Section 46.15(j), Penal Code, is amended to read
8282 as follows:
8383 (j) The provisions of Sections 46.02 and 46.03(a)(7),
8484 (a-2), and (a-3) [, and (a-4)] do not apply to an individual who
8585 carries a handgun as a participant in a historical reenactment
8686 performed in accordance with the rules of the Texas Alcoholic
8787 Beverage Commission.
8888 SECTION 5. The following laws are repealed:
8989 (1) Sections 411.2031(c), (d-1), (d-2), (d-3), and
9090 (d-4), Government Code; and
9191 (2) Section 46.03(a-4), Penal Code.
9292 SECTION 6. Section 411.208, Government Code, as amended by
9393 this Act, applies only to a cause of action that accrues on or after
9494 the effective date of this Act. A cause of action that accrues
9595 before the effective date of this Act is governed by the law in
9696 effect immediately before that date, and that law is continued in
9797 effect for that purpose.
9898 SECTION 7. The change in law made by this Act applies only
9999 to an offense committed on or after the effective date of this Act.
100100 An offense committed before the effective date of this Act is
101101 governed by the law in effect on the date the offense was committed,
102102 and the former law is continued in effect for that purpose. For
103103 purposes of this section, an offense was committed before the
104104 effective date of this Act if any element of the offense occurred
105105 before that date.
106106 SECTION 8. This Act takes effect September 1, 2025.
