77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the unauthorized occupancy of real property, including
1010 the removal of certain unauthorized occupants; creating a criminal
1111 offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 30, Penal Code, is amended by adding
1414 Section 30.08 to read as follows:
1515 Sec. 30.08. SQUATTING. (a) A person commits an offense if
1616 the person:
1717 (1) occupies the property of another without the
1818 effective consent of the owner or other person authorized by a lease
1919 or other agreement to occupy the property; and
2020 (2) knows or reasonably should know that the person
2121 does not have the effective consent of the owner or other person
2222 authorized by a lease or other agreement to occupy the property.
2323 (b) An offense under this section is a state jail felony.
2424 (c) If conduct that constitutes an offense under this
2525 section also constitutes an offense under another law, the actor
2626 may be prosecuted under this section or the other law, but not both.
2727 SECTION 2. Title 4, Property Code, is amended by adding
2828 Chapter 24B to read as follows:
2929 CHAPTER 24B. REMOVAL OF CERTAIN UNAUTHORIZED OCCUPANTS OF REAL
3030 PROPERTY
3131 Sec. 24B.001. RIGHT TO REQUEST REMOVAL OF UNAUTHORIZED
3232 OCCUPANT OF DWELLING BY SHERIFF. Notwithstanding any other law, an
3333 owner of residential real property, the owner's agent, or a person
3434 authorized by a lease or other agreement to occupy the property may
3535 request that the sheriff of the county in which the property is
3636 located immediately remove a person who unlawfully entered and is
3737 occupying a dwelling on the property without the consent of the
3838 owner or the person authorized by a lease or other agreement to
3939 occupy the property.
4040 Sec. 24B.002. COMPLAINT TO REQUEST REMOVAL OF UNAUTHORIZED
4141 OCCUPANT. (a) A person entitled to request the removal of a person
4242 under Section 24B.001 may make the request by submitting to the
4343 sheriff of the county in which the property is located a written
4444 complaint that complies with Subsection (b) and includes a
4545 statement that:
4646 (1) the complainant is entitled to possession of the
4747 property;
4848 (2) a person occupies a dwelling on the property
4949 without the complainant's consent;
5050 (3) the complainant has directed the person to leave
5151 the property and the person has not done so; and
5252 (4) the complainant is requesting that the sheriff
5353 remove each person occupying the dwelling without the complainant's
5454 consent.
5555 (b) A complaint submitted under this section must be made
5656 under oath or made as an unsworn declaration under Section 132.001,
5757 Civil Practice and Remedies Code.
5858 Sec. 24B.003. NOTICE OF COMPLAINT; OCCUPANT RESPONSE. (a)
5959 A sheriff who receives a complaint under Section 24B.002 shall make
6060 contact with the person occupying the dwelling and serve on the
6161 person in a manner described by Section 24B.004(b) written notice
6262 of the complaint and at least one method by which the person may
6363 provide evidence to the sheriff under Subsection (b).
6464 (b) Not later than the third day after the date that the
6565 notice is received under Subsection (a), the person occupying the
6666 dwelling may provide to the sheriff evidence that the complainant
6767 is not entitled to the relief sought in the complaint.
6868 (c) If the person occupying the dwelling provides evidence,
6969 including a properly executed lease or rental agreement or proof of
7070 rental payments, to the sheriff under Subsection (b) that the
7171 sheriff finds sufficient to raise a question of fact regarding the
7272 complainant's right to relief, the sheriff shall provide notice to
7373 the complainant that the complainant is not entitled to relief
7474 under this chapter.
7575 Sec. 24B.004. SERVICE OF NOTICE TO IMMEDIATELY VACATE. (a)
7676 If evidence described by Section 24B.003(c) is not provided to the
7777 sheriff in the time provided by Section 24B.003(b), the sheriff
7878 shall without delay:
7979 (1) serve notice to immediately vacate on the person
8080 occupying the dwelling without the consent of the owner or the
8181 person authorized by a lease or other agreement to occupy the
8282 property, as applicable;
8383 (2) arrest the person occupying the dwelling for an
8484 offense under Section 30.08, Penal Code; and
8585 (3) put the owner or the person authorized by a lease
8686 or other agreement to occupy the property, as applicable, in
8787 possession of the dwelling.
8888 (b) Service of notice to immediately vacate may be
8989 accomplished by:
9090 (1) hand delivery to an occupant of the dwelling; or
9191 (2) affixing the notice to the front door or entrance
9292 of the dwelling.
9393 SECTION 3. This Act takes effect September 1, 2025.
