77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the election of junior college district trustees by
1010 plurality vote.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 130.082, Education Code, is amended by
1313 amending Subsections (g) and (i) to read as follows:
1414 (g) The board shall designate a number for the position held
1515 by each member of the board, from one upward in consecutive
1616 numerical order in such manner that the lowest numbers shall be
1717 assigned to the members whose terms of office expire in the shortest
1818 length of time, provided that any such position number designations
1919 on existing boards under existing law at the effective date of this
2020 act shall remain in effect. At each election candidates shall be
2121 voted upon and be elected separately for each position on the board,
2222 and the name of each candidate shall be placed on the official
2323 ballot according to the number of the position for which the
2424 candidate [he or she] is running. [A candidate receiving a majority
2525 of the votes cast for all candidates for a position shall be
2626 declared elected. If no candidate receives such a majority, then
2727 the two candidates receiving the highest number of votes shall run
2828 against each other for the position. The run-off election for all
2929 positions shall be held on a date that complies with law and shall
3030 be ordered, notice thereof given, and held, as provided herein for
3131 regular elections.] Any resident, qualified elector of the
3232 district may apply for a place [have his or her name placed as a
3333 candidate] on the official ballot for any position to be filled at
3434 each regular election by filing with the secretary of the board a
3535 written application [therefor] signed by the applicant, not later
3636 than 5 p.m. of the 45th day before the date of the election. An
3737 application may not be filed earlier than the 30th day before the
3838 date of the filing deadline. The [Such] application must state the
3939 number of the position for which the applicant [he or she] is a
4040 candidate, or the name of the incumbent member of the board holding
4141 the position for which the applicant [he or she] desires to run.
4242 The location on the ballot of the names of candidates for each
4343 position shall be chosen by lot by the board. A candidate shall be
4444 eligible to run for only one position at each election.
4545 (i) The election of trustees of a countywide junior or
4646 community college district that contains a city with a population
4747 of more than 1.18 million located primarily in a county with a
4848 population of 2.5 million or more shall be held on the first
4949 Saturday in April of each even-numbered year. [When a runoff
5050 election is necessary, the board may order the election for a date
5151 to coincide with the date of the runoff election for city officials,
5252 if the city is holding a runoff election; otherwise, the board shall
5353 set the date of the runoff election for not later than three weeks
5454 following the regular election.]
5555 SECTION 2. Section 130.088(l), Education Code, is repealed.
5656 SECTION 3. This Act takes effect September 1, 2025.
