11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 130.082, Education Code, is amended by |
---|
13 | 13 | | amending Subsections (g) and (i) to read as follows: |
---|
14 | 14 | | (g) The board shall designate a number for the position held |
---|
15 | 15 | | by each member of the board, from one upward in consecutive |
---|
16 | 16 | | numerical order in such manner that the lowest numbers shall be |
---|
17 | 17 | | assigned to the members whose terms of office expire in the shortest |
---|
18 | 18 | | length of time, provided that any such position number designations |
---|
19 | 19 | | on existing boards under existing law at the effective date of this |
---|
20 | 20 | | act shall remain in effect. At each election candidates shall be |
---|
21 | 21 | | voted upon and be elected separately for each position on the board, |
---|
22 | 22 | | and the name of each candidate shall be placed on the official |
---|
23 | 23 | | ballot according to the number of the position for which the |
---|
24 | 24 | | candidate [he or she] is running. [A candidate receiving a majority |
---|
25 | 25 | | of the votes cast for all candidates for a position shall be |
---|
26 | 26 | | declared elected. If no candidate receives such a majority, then |
---|
27 | 27 | | the two candidates receiving the highest number of votes shall run |
---|
28 | 28 | | against each other for the position. The run-off election for all |
---|
29 | 29 | | positions shall be held on a date that complies with law and shall |
---|
30 | 30 | | be ordered, notice thereof given, and held, as provided herein for |
---|
31 | 31 | | regular elections.] Any resident, qualified elector of the |
---|
32 | 32 | | district may apply for a place [have his or her name placed as a |
---|
33 | 33 | | candidate] on the official ballot for any position to be filled at |
---|
34 | 34 | | each regular election by filing with the secretary of the board a |
---|
35 | 35 | | written application [therefor] signed by the applicant, not later |
---|
36 | 36 | | than 5 p.m. of the 45th day before the date of the election. An |
---|
37 | 37 | | application may not be filed earlier than the 30th day before the |
---|
38 | 38 | | date of the filing deadline. The [Such] application must state the |
---|
39 | 39 | | number of the position for which the applicant [he or she] is a |
---|
40 | 40 | | candidate, or the name of the incumbent member of the board holding |
---|
41 | 41 | | the position for which the applicant [he or she] desires to run. |
---|
42 | 42 | | The location on the ballot of the names of candidates for each |
---|
43 | 43 | | position shall be chosen by lot by the board. A candidate shall be |
---|
44 | 44 | | eligible to run for only one position at each election. |
---|
45 | 45 | | (i) The election of trustees of a countywide junior or |
---|
46 | 46 | | community college district that contains a city with a population |
---|
47 | 47 | | of more than 1.18 million located primarily in a county with a |
---|
48 | 48 | | population of 2.5 million or more shall be held on the first |
---|
49 | 49 | | Saturday in April of each even-numbered year. [When a runoff |
---|
50 | 50 | | election is necessary, the board may order the election for a date |
---|
51 | 51 | | to coincide with the date of the runoff election for city officials, |
---|
52 | 52 | | if the city is holding a runoff election; otherwise, the board shall |
---|
53 | 53 | | set the date of the runoff election for not later than three weeks |
---|
54 | 54 | | following the regular election.] |

55 | 55 | | SECTION 2. Section 130.088(l), Education Code, is repealed. |
---|
56 | 56 | | SECTION 3. This Act takes effect September 1, 2025. |
