| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2306.6710(g), Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (g) If no written statement is received for an application |
|---|
| 14 | 14 | | under Subsection (b)(1)(J) or the written statement does not |
|---|
| 15 | 15 | | express support for or against the application, the department |
|---|
| 16 | 16 | | shall use the maximum number of points that could have been awarded |
|---|
| 17 | 17 | | under that paragraph to increase the maximum number of points that |
|---|
| 18 | 18 | | may be awarded for that application under Subsection (b)(1)(B). If |
|---|
| 19 | 19 | | awarding points under Subsection (b)(1)(B)(iii), the department |
|---|
| 20 | 20 | | shall reallocate the points from the scoring category provided by |
|---|
| 21 | 21 | | Subsection (b)(1)(J) equally between the political subdivisions |
|---|
| 22 | 22 | | described by Subsection (b)(1)(B)(iii). In awarding points |
|---|
| 23 | 23 | | transferred under this subsection from the scoring category |
|---|
| 24 | 24 | | provided by Subsection (b)(1)(J) to the scoring category provided |
|---|
| 25 | 25 | | by Subsection (b)(1)(B), the department shall award: |
|---|
| 26 | 26 | | (1) positive points for positive resolutions adopted; |
|---|
| 27 | 27 | | (2) negative points for negative resolutions adopted; |
|---|
| 28 | 28 | | and |
|---|
| 29 | 29 | | (3) zero points for neutral resolutions adopted. |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to an application for low income housing tax credits that is |
|---|
| 32 | 32 | | submitted to the Texas Department of Housing and Community Affairs |
|---|
| 33 | 33 | | during an application cycle that is based on the 2026 qualified |
|---|
| 34 | 34 | | allocation plan or a subsequent plan adopted by the governing board |
|---|
| 35 | 35 | | of the department. An application that is submitted during an |
|---|
| 36 | 36 | | application cycle that is based on an earlier qualified allocation |
|---|
| 37 | 37 | | plan is governed by the law in effect on the date the application |
|---|
| 38 | 38 | | cycle began, and the former law is continued in effect for that |
|---|
| 39 | 39 | | purpose. |

| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2025. |
