77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the allocation of low income housing tax credits.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2306.6710(g), Government Code, is
1212 amended to read as follows:
1313 (g) If no written statement is received for an application
1414 under Subsection (b)(1)(J) or the written statement does not
1515 express support for or against the application, the department
1616 shall use the maximum number of points that could have been awarded
1717 under that paragraph to increase the maximum number of points that
1818 may be awarded for that application under Subsection (b)(1)(B). If
1919 awarding points under Subsection (b)(1)(B)(iii), the department
2020 shall reallocate the points from the scoring category provided by
2121 Subsection (b)(1)(J) equally between the political subdivisions
2222 described by Subsection (b)(1)(B)(iii). In awarding points
2323 transferred under this subsection from the scoring category
2424 provided by Subsection (b)(1)(J) to the scoring category provided
2525 by Subsection (b)(1)(B), the department shall award:
2626 (1) positive points for positive resolutions adopted;
2727 (2) negative points for negative resolutions adopted;
2828 and
2929 (3) zero points for neutral resolutions adopted.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an application for low income housing tax credits that is
3232 submitted to the Texas Department of Housing and Community Affairs
3333 during an application cycle that is based on the 2026 qualified
3434 allocation plan or a subsequent plan adopted by the governing board
3535 of the department. An application that is submitted during an
3636 application cycle that is based on an earlier qualified allocation
3737 plan is governed by the law in effect on the date the application
3838 cycle began, and the former law is continued in effect for that
3939 purpose.
4040 SECTION 3. This Act takes effect September 1, 2025.
