57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to fees on and grants for fuel ethanol, renewable methane,
810 biodiesel, and renewable diesel.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 16.005(a), Agriculture Code, as amended
1113 by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
1214 Legislature, Regular Session, 2009, is reenacted to read as
1315 follows:
1416 (a) The office shall impose a fee on each producer in an
1517 amount equal to 3.2 cents for each gallon of fuel ethanol, renewable
1618 diesel, or MMBtu of renewable methane and 1.6 cents for each gallon
1719 of biodiesel produced in each registered plant operated by the
1820 producer.
1921 SECTION 2. Section 16.006(b), Agriculture Code, as amended
2022 by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
2123 Legislature, Regular Session, 2009, is reenacted to read as
2224 follows:
2325 (b) A producer is entitled to receive from the account 20
2426 cents for each gallon of fuel ethanol, renewable diesel, or MMBtu of
2527 renewable methane and 10 cents for each gallon of biodiesel
2628 produced in each registered plant operated by the producer until
2729 the 10th anniversary of the date production from the plant begins.
2830 SECTION 3. This Act takes effect immediately if it receives
2931 a vote of two-thirds of all the members elected to each house, as
3032 provided by Section 39, Article III, Texas Constitution. If this
3133 Act does not receive the vote necessary for immediate effect, this
3234 Act takes effect September 1, 2025.
