77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to consumer protections against certain medical and health
1010 care billing by emergency medical services providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 773.061, Health and Safety Code, is
1313 amended by adding Subsection (a-1) to read as follows:
1414 (a-1) In addition to other permissible actions or penalties
1515 and regardless of whether an emergency medical services provider is
1616 directly operated by a governmental entity, the department may
1717 revoke, suspend, or refuse to renew a license or certificate of the
1818 provider if the department confirms that the provider has:
1919 (1) intentionally submitted incorrect information
2020 required under Section 38.006, Insurance Code; or
2121 (2) engaged in a pattern of violations of Section
2222 1271.159, 1275.054, 1301.166, 1551.231, 1575.174, or 1579.112,
2323 Insurance Code.
2424 SECTION 2. Section 38.006(b), Insurance Code, is amended to
2525 read as follows:
2626 (b) This section expires September 1, 2027 [2025].
2727 SECTION 3. Sections 1271.159(c) and (g), Insurance Code,
2828 are amended to read as follows:
2929 (c) A political subdivision may annually [health
3030 maintenance organization shall] adjust a rate submitted under
3131 Section 38.006 [payment required by Subsection (b)(1) each plan
3232 year] by not more than [increasing the payment by] the lesser of:
3333 (1) the Medicare Ambulance Inflation Factor; [Index]
3434 or
3535 (2) 10 percent of the provider's previous calendar
3636 year rates.
3737 (g) This section expires September 1, 2027 [2025].
3838 SECTION 4. Sections 1275.054(c) and (f), Insurance Code,
3939 are amended to read as follows:
4040 (c) A political subdivision may annually [The administrator
4141 shall] adjust a rate submitted under Section 38.006 [payment
4242 required by Subsection (b)(1) each plan year] by not more than
4343 [increasing the payment by] the lesser of:
4444 (1) the Medicare Ambulance Inflation Factor; [Index]
4545 or
4646 (2) 10 percent of the provider's previous calendar
4747 year rates.
4848 (f) This section expires September 1, 2027 [2025].
4949 SECTION 5. Sections 1301.166(c) and (g), Insurance Code,
5050 are amended to read as follows:
5151 (c) A political subdivision may annually [An insurer shall]
5252 adjust a rate submitted under Section 38.006 [payment required by
5353 Subsection (b)(1) each plan year] by not more than [increasing the
5454 payment by] the lesser of:
5555 (1) the Medicare Ambulance Inflation Factor; [Index]
5656 or
5757 (2) 10 percent of the provider's previous calendar
5858 year rates.
5959 (g) This section expires September 1, 2027 [2025].
6060 SECTION 6. Sections 1551.231(c) and (f), Insurance Code,
6161 are amended to read as follows:
6262 (c) A political subdivision may annually [The administrator
6363 shall] adjust a rate submitted under Section 38.006 [payment
6464 required by Subsection (b)(1) each plan year] by not more than
6565 [increasing the payment by] the lesser of:
6666 (1) the Medicare Ambulance Inflation Factor; [Index]
6767 or
6868 (2) 10 percent of the provider's previous calendar
6969 year rates.
7070 (f) This section expires September 1, 2027 [2025].
7171 SECTION 7. Sections 1575.174(c) and (f), Insurance Code,
7272 are amended to read as follows:
7373 (c) A political subdivision may annually [The administrator
7474 shall] adjust a rate submitted under Section 38.006 [payment
7575 required by Subsection (b)(1) each plan year] by not more than
7676 [increasing the payment by] the lesser of:
7777 (1) the Medicare Ambulance Inflation Factor; [Index]
7878 or
7979 (2) 10 percent of the provider's previous calendar
8080 year rates.
8181 (f) This section expires September 1, 2027 [2025].
8282 SECTION 8. Sections 1579.112(c) and (f), Insurance Code,
8383 are amended to read as follows:
8484 (c) A political subdivision may annually [The administrator
8585 shall] adjust a rate submitted under Section 38.006 [payment
8686 required by Subsection (b)(1) each plan year] by not more than
8787 [increasing the payment by] the lesser of:
8888 (1) the Medicare Ambulance Inflation Factor; [Index]
8989 or
9090 (2) 10 percent of the provider's previous calendar
9191 year rates.
9292 (f) This section expires September 1, 2027 [2025].
9393 SECTION 9. The changes in law made by this Act apply only to
9494 emergency medical services provided on or after the effective date
9595 of this Act. Emergency medical services provided before the
9696 effective date of this Act are governed by the law in effect
9797 immediately before the effective date of this Act, and that law is
9898 continued in effect for that purpose.
9999 SECTION 10. This Act takes effect September 1, 2025.
