8	8	AN ACT
9	9	relating to consumer protections against certain medical and health
10	10	care billing by emergency medical services providers.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 773.061, Health and Safety Code, is
13	13	amended by adding Subsection (a-1) to read as follows:
14	14	(a-1) In addition to other permissible actions or penalties
15	15	and regardless of whether an emergency medical services provider is
16	16	directly operated by a governmental entity, the department may
17	17	revoke, suspend, or refuse to renew a license or certificate of the
18	18	provider if the department confirms that the provider has:
19	19	(1) intentionally submitted incorrect information
20	20	required under Section 38.006, Insurance Code; or
21	21	(2) engaged in a pattern of violations of Section
22	22	1271.159, 1275.054, 1301.166, 1551.231, 1575.174, or 1579.112,
23	23	Insurance Code.
24	24	SECTION 2. Section 38.006(b), Insurance Code, is amended to
25	25	read as follows:
26	26	(b) This section expires September 1, 2027 [2025].
27	27	SECTION 3. Sections 1271.159(c) and (g), Insurance Code,
28	28	are amended to read as follows:
29	29	(c) A political subdivision may annually [health
30	30	maintenance organization shall] adjust a rate submitted under
31	31	Section 38.006 [payment required by Subsection (b)(1) each plan
32	32	year] by not more than [increasing the payment by] the lesser of:
33	33	(1) the Medicare Ambulance Inflation Factor; [Index]
34	34	or
35	35	(2) 10 percent of the provider's previous calendar
36	36	year rates.
37	37	(g) This section expires September 1, 2027 [2025].
38	38	SECTION 4. Sections 1275.054(c) and (f), Insurance Code,
39	39	are amended to read as follows:
40	40	(c) A political subdivision may annually [The administrator
41	41	shall] adjust a rate submitted under Section 38.006 [payment
42	42	required by Subsection (b)(1) each plan year] by not more than
43	43	[increasing the payment by] the lesser of:
44	44	(1) the Medicare Ambulance Inflation Factor; [Index]
45	45	or
46	46	(2) 10 percent of the provider's previous calendar
47	47	year rates.
48	48	(f) This section expires September 1, 2027 [2025].
49	49	SECTION 5. Sections 1301.166(c) and (g), Insurance Code,
50	50	are amended to read as follows:
51	51	(c) A political subdivision may annually [An insurer shall]
52	52	adjust a rate submitted under Section 38.006 [payment required by
53	53	Subsection (b)(1) each plan year] by not more than [increasing the
54	54	payment by] the lesser of:
55	55	(1) the Medicare Ambulance Inflation Factor; [Index]
56	56	or
57	57	(2) 10 percent of the provider's previous calendar
58	58	year rates.
59	59	(g) This section expires September 1, 2027 [2025].
60	60	SECTION 6. Sections 1551.231(c) and (f), Insurance Code,
61	61	are amended to read as follows:
62	62	(c) A political subdivision may annually [The administrator
63	63	shall] adjust a rate submitted under Section 38.006 [payment
64	64	required by Subsection (b)(1) each plan year] by not more than
65	65	[increasing the payment by] the lesser of:
66	66	(1) the Medicare Ambulance Inflation Factor; [Index]

71	71	SECTION 7. Sections 1575.174(c) and (f), Insurance Code,
72	72	are amended to read as follows:

83	83	are amended to read as follows:

86	86	required by Subsection (b)(1) each plan year] by not more than
87	87	[increasing the payment by] the lesser of:
88	88	(1) the Medicare Ambulance Inflation Factor; [Index]

90	90	(2) 10 percent of the provider's previous calendar
91	91	year rates.
92	92	(f) This section expires September 1, 2027 [2025].
93	93	SECTION 9. The changes in law made by this Act apply only to
94	94	emergency medical services provided on or after the effective date
95	95	of this Act. Emergency medical services provided before the
96	96	effective date of this Act are governed by the law in effect
97	97	immediately before the effective date of this Act, and that law is
98	98	continued in effect for that purpose.
99	99	SECTION 10. This Act takes effect September 1, 2025.
