77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain duties of the Texas Board of Nursing and the
1010 Texas Higher Education Coordinating Board in relation to the
1111 reporting and publication of nursing program clinical site data.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1414 amended by adding Section 61.066 to read as follows:
1515 Sec. 61.066. NURSING PROGRAM CLINICAL SITE DATA. (a) In
1616 this section, "clinical site" has the meaning assigned by Section
1717 61.9641.
1818 (b) The board shall annually publish information regarding
1919 clinical sites approved by the Texas Board of Nursing for
2020 professional nursing programs, including:
2121 (1) the location of each clinical site;
2222 (2) the number of students receiving clinical training
2323 at each clinical site; and
2424 (3) the total capacity at each clinical site for
2525 nursing students to participate in clinical training.
2626 (c) This section may not be construed to authorize the board
2727 to mandate all acute care or rehabilitation facilities, primary
2828 care settings, long-term care facilities, nursing homes, and
2929 residential care settings to participate in clinical education
3030 programs or require additional reporting from those facilities.
3131 SECTION 2. Subchapter D, Chapter 301, Occupations Code, is
3232 amended by adding Section 301.169 to read as follows:
3333 Sec. 301.169. NURSING PROGRAM CLINICAL SITE DATA; ANNUAL
3434 REPORT. (a) In this section:
3535 (1) "Clinical site" has the meaning assigned by
3636 Section 61.9641, Education Code.
3737 (2) "Professional nursing program" has the meaning
3838 assigned by Section 61.9621, Education Code.
3939 (b) The board shall:
4040 (1) provide to the Texas Higher Education Coordinating
4141 Board information detailing the requirements for approving
4242 clinical sites for professional nursing programs; and
4343 (2) identify and provide a list to the Texas Higher
4444 Education Coordinating Board of all acute care or rehabilitation
4545 facilities, primary care settings, long-term care facilities,
4646 nursing homes, residential care settings, and any other appropriate
4747 sites not identified by the board as clinical sites that meet the
4848 requirements described by Subdivision (1).
4949 (c) Not later than June 1 of each year, the board shall
5050 prepare and provide to the Texas Higher Education Coordinating
5151 Board a report with the information described by Section 61.066,
5252 Education Code.
5353 SECTION 3. Not later than June 1, 2026, the Texas Board of
5454 Nursing shall prepare and submit the initial report required by
5555 Section 301.169, Occupations Code, as added by this Act.
5656 SECTION 4. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2025.
