8	8	AN ACT
9	9	relating to certain duties of the Texas Board of Nursing and the
10	10	Texas Higher Education Coordinating Board in relation to the
11	11	reporting and publication of nursing program clinical site data.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter C, Chapter 61, Education Code, is
14	14	amended by adding Section 61.066 to read as follows:
15	15	Sec. 61.066. NURSING PROGRAM CLINICAL SITE DATA. (a) In
16	16	this section, "clinical site" has the meaning assigned by Section
17	17	61.9641.
18	18	(b) The board shall annually publish information regarding
19	19	clinical sites approved by the Texas Board of Nursing for
20	20	professional nursing programs, including:
21	21	(1) the location of each clinical site;
22	22	(2) the number of students receiving clinical training
23	23	at each clinical site; and
24	24	(3) the total capacity at each clinical site for
25	25	nursing students to participate in clinical training.
26	26	(c) This section may not be construed to authorize the board
27	27	to mandate all acute care or rehabilitation facilities, primary
28	28	care settings, long-term care facilities, nursing homes, and
29	29	residential care settings to participate in clinical education
30	30	programs or require additional reporting from those facilities.
31	31	SECTION 2. Subchapter D, Chapter 301, Occupations Code, is
32	32	amended by adding Section 301.169 to read as follows:
33	33	Sec. 301.169. NURSING PROGRAM CLINICAL SITE DATA; ANNUAL
34	34	REPORT. (a) In this section:
35	35	(1) "Clinical site" has the meaning assigned by
36	36	Section 61.9641, Education Code.
37	37	(2) "Professional nursing program" has the meaning
38	38	assigned by Section 61.9621, Education Code.
39	39	(b) The board shall:
40	40	(1) provide to the Texas Higher Education Coordinating
41	41	Board information detailing the requirements for approving
42	42	clinical sites for professional nursing programs; and
43	43	(2) identify and provide a list to the Texas Higher
44	44	Education Coordinating Board of all acute care or rehabilitation
45	45	facilities, primary care settings, long-term care facilities,
46	46	nursing homes, residential care settings, and any other appropriate
47	47	sites not identified by the board as clinical sites that meet the
48	48	requirements described by Subdivision (1).
49	49	(c) Not later than June 1 of each year, the board shall
50	50	prepare and provide to the Texas Higher Education Coordinating
51	51	Board a report with the information described by Section 61.066,
52	52	Education Code.
53	53	SECTION 3. Not later than June 1, 2026, the Texas Board of
54	54	Nursing shall prepare and submit the initial report required by
55	55	Section 301.169, Occupations Code, as added by this Act.
56	56	SECTION 4. This Act takes effect immediately if it receives
57	57	a vote of two-thirds of all the members elected to each house, as
58	58	provided by Section 39, Article III, Texas Constitution. If this
59	59	Act does not receive the vote necessary for immediate effect, this
60	60	Act takes effect September 1, 2025.
