| 8 | 8 | | relating to the relocation of the headquarters for certain state |
|---|
| 9 | 9 | | agencies. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 325.008(a), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) Before January 1 of the year in which a state agency |
|---|
| 14 | 14 | | subject to this chapter and its advisory committees are abolished, |
|---|
| 15 | 15 | | the commission shall: |
|---|
| 16 | 16 | | (1) review and take action necessary to verify the |
|---|
| 17 | 17 | | reports submitted by the agency under Section 325.007; |
|---|
| 18 | 18 | | (2) consult the Legislative Budget Board, the |
|---|
| 19 | 19 | | Governor's Budget, Policy, and Planning Division, the State |
|---|
| 20 | 20 | | Auditor, and the comptroller of public accounts, or their |
|---|
| 21 | 21 | | successors, on the application to the agency of the criteria |
|---|
| 22 | 22 | | provided in Section 325.011; |
|---|
| 23 | 23 | | (3) conduct a review of the agency based an the |
|---|
| 24 | 24 | | criteria provided in Section 325.011 and prepare a written report; |
|---|
| 25 | 25 | | [and] |
|---|
| 26 | 26 | | (4) conduct the evaluation required by Section |
|---|
| 27 | 27 | | 325.0085; and |
|---|
| 28 | 28 | | (5) review the implementation of commission |
|---|
| 29 | 29 | | recommendations contained in the reports presented to the |
|---|
| 30 | 30 | | legislature during the preceding legislative session and the |
|---|
| 31 | 31 | | resulting legislation. |
|---|
| 32 | 32 | | SECTION 2. Chapter 325, Government Code, is amended by |
|---|
| 33 | 33 | | adding Section 325.0085 to read as follows: |
|---|
| 34 | 34 | | Sec. 325.0085. RELOCATION OF STATE AGENCY HEADQUARTERS. |
|---|
| 35 | 35 | | (a) For each state agency reviewed under this chapter whose |
|---|
| 36 | 36 | | headquarters is located in Travis County or an adjacent county, the |
|---|
| 37 | 37 | | commission, with the assistance of the Texas Facilities Commission, |
|---|
| 38 | 38 | | shall evaluate the cost savings to this state of relocating the |
|---|
| 39 | 39 | | state agency's headquarters to a location outside of Travis County |
|---|
| 40 | 40 | | or an adjacent county. In determining the cost savings to the |
|---|
| 41 | 41 | | state, the commission shall consider the following factors over a |
|---|
| 42 | 42 | | 10-year period: |
|---|
| 43 | 43 | | (1) the cost of leasing or purchasing office space for |
|---|
| 44 | 44 | | the state agency in a location outside of Travis County or an |
|---|
| 45 | 45 | | adjacent county; |
|---|
| 46 | 46 | | (2) the cost of moving the state agency to the new |
|---|
| 47 | 47 | | location; |
|---|
| 48 | 48 | | (3) the market value of any state-owned property |
|---|
| 49 | 49 | | currently being used for the state agency's headquarters, including |
|---|
| 50 | 50 | | the amount of income the state could earn by leasing or selling the |
|---|
| 51 | 51 | | property; and |
|---|
| 52 | 52 | | (4) any other information the commission or Texas |
|---|
| 53 | 53 | | Facilities Commission considers relevant in determining whether |
|---|
| 54 | 54 | | the relocation creates a cost saving to this state. |
|---|
| 55 | 55 | | (b) If the commission determines relocating a state agency |
|---|
| 56 | 56 | | creates a cost saving to this state, the state agency shall relocate |
|---|
| 57 | 57 | | the agency's headquarters to the location determined by the |
|---|
| 58 | 58 | | commission under this section. |
|---|
| 59 | 59 | | SECTION 3. This Act takes effect September 1, 2025. |
