77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the sales and use tax exemption for the repair,
1010 remodeling, or maintenance of aircraft.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 151.328(b), (d), and (e), Tax Code, are
1313 amended to read as follows:
1414 (b) Repair, remodeling, and maintenance services to
1515 aircraft, including an engine or other component part of aircraft,
1616 [operated by a person described by Subsection (a)(1), (a)(2), or
1717 (a)(5)] are exempted from the taxes imposed by this chapter.
1818 (d) Machinery, tools, supplies, and equipment used or
1919 consumed exclusively in the repair, remodeling, or maintenance of
2020 aircraft, aircraft engines, or aircraft component parts [by or on
2121 behalf of a person described by Subsection (a)(1) or (a)(2)] are
2222 exempted from the taxes imposed by this chapter.
2323 (e) Tangible personal property that is permanently affixed
2424 or attached as a component part of an aircraft [owned or operated by
2525 a person described by Subsection (a)(1) or (a)(2),] or that is
2626 necessary for the normal operations of the aircraft and is pumped,
2727 poured, or otherwise placed in the aircraft[,] is exempted from the
2828 taxes imposed by this chapter.
2929 SECTION 2. The changes in law made by this Act do not affect
3030 tax liability accruing before the effective date of this Act. That
3131 liability continues in effect as if this Act had not been enacted,
3232 and the former law is continued in effect for the collection of
3333 taxes due and for civil and criminal enforcement of the liability
3434 for those taxes.
3535 SECTION 3. This Act takes effect September 1, 2025.
