| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Chapter 542A, Insurance Code, is amended by | |
| 14 | 14 | adding Section 542A.008 to read as follows: | |
| 15 | 15 | Sec. 542A.008. EFFECT OF PAYMENT AFTER NOTICE DEADLINE. | |
| 16 | 16 | Any payment made after the deadline for presuit notice under | |
| 17 | 17 | Section 542A.003 does not limit in any way an insured's right to | |
| 18 | 18 | recover interest, penalties, attorney's fees, or any other | |
| 19 | 19 | noneconomic damages for the claim for which the payment was made. | |
| 20 | 20 | SECTION 2. Section 542A.008, Insurance Code, as added by | |
| 21 | 21 | this Act, applies only to an action that commences on or after the | |
| 22 | 22 | effective date of this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2025. |
