11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 442, Government Code, is amended by |
---|
13 | 13 | | adding Subchapter B-3 to read as follows: |
---|
14 | 14 | | SUBCHAPTER B-3. EYES OF FATHER MARGIL STATE HISTORIC SITE AND TRAIL |
---|
15 | 15 | | Sec. 442.068. DEFINITIONS. In this subchapter: |
---|
16 | 16 | | (1) "Commission" means the Texas Historical |
---|
17 | 17 | | Commission. |
---|
18 | 18 | | (2) "Fund" means the Eyes of Father Margil State |
---|
19 | 19 | | Historic Site and Trail fund established under Section 442.0682. |
---|
20 | 20 | | (3) "Historic site" means the Eyes of Father Margil |
---|
21 | 21 | | State Historic Site and Trail in Nacogdoches, Texas. |
---|
22 | 22 | | Sec. 442.0681. EYES OF FATHER MARGIL STATE HISTORIC SITE |
---|
23 | 23 | | AND TRAIL. (a) To the extent authorized by law, the commission may |
---|
24 | 24 | | contract with the municipality that owns the Eyes of Father Margil |
---|
25 | 25 | | State Historic Site and Trail for the commission to assume |
---|
26 | 26 | | operation and administration of the historic site. |
---|
27 | 27 | | (b) A contract executed under Subsection (a) must contain |
---|
28 | 28 | | provisions for: |
---|
29 | 29 | | (1) expanding, renovating, managing, maintaining, |
---|
30 | 30 | | operating, or providing financial support for the historic site, |
---|
31 | 31 | | including administration, construction, and operation of a visitor |
---|
32 | 32 | | center, and related activities; |
---|
33 | 33 | | (2) preserving for the historic site artifacts, |
---|
34 | 34 | | relics, and other items of historical interest; |
---|
35 | 35 | | (3) employing for the historic site a director and |
---|
36 | 36 | | other employees the commission considers necessary to fulfill the |
---|
37 | 37 | | commission's duties and responsibilities under the contract; |
---|
38 | 38 | | (4) accepting donations of money, property, and |
---|
39 | 39 | | historical relics for the historic site; and |
---|
40 | 40 | | (5) acquiring for the historic site property and |
---|
41 | 41 | | historical relics with money available for that purpose. |
---|
42 | 42 | | Sec. 442.0682. EYES OF FATHER MARGIL STATE HISTORIC SITE |
---|
43 | 43 | | AND TRAIL FUND. (a) The Eyes of Father Margil State Historic Site |
---|
44 | 44 | | and Trail fund is created as a fund outside the state treasury. The |
---|
45 | 45 | | commission shall administer the fund but may contract with the |
---|
46 | 46 | | municipality that owns the historic site for administration of the |
---|
47 | 47 | | fund. |
---|
48 | 48 | | (b) The fund consists of: |
---|
49 | 49 | | (1) admissions revenue from the operation of the |
---|
50 | 50 | | historic site; |
---|
51 | 51 | | (2) sales revenue from the operation of the historic |
---|
52 | 52 | | site gift shop; and |
---|
53 | 53 | | (3) donations to the commission for the historic site. |
---|
54 | 54 | | (c) Money in the fund may be spent without legislative |
---|
55 | 55 | | appropriation and only to administer, operate, preserve, repair, |
---|
56 | 56 | | expand, or otherwise maintain the historic site. |
---|
57 | 57 | | (d) Interest and income from the assets of the fund shall be |
---|
58 | 58 | | credited to and deposited in the fund. |
---|
59 | 59 | | Sec. 442.0683. GRANTS; DONATIONS. The commission may |
---|
60 | 60 | | accept a grant or donation for the operation and administration of |
---|
61 | 61 | | the historic site. |
---|
62 | 62 | | SECTION 2. This Act takes effect immediately if it receives |
---|
63 | 63 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 64 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 65 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 66 | | Act takes effect September 1, 2025. |
