| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter Z, Chapter 39A, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 39A.908 to read as follows: |
|---|
| 15 | 15 | | Sec. 39A.908. PERFORMANCE STANDARDS FOR REMOVAL OF |
|---|
| 16 | 16 | | CONSERVATOR, MANAGEMENT TEAM, OR BOARD OF MANAGERS. (a) The |
|---|
| 17 | 17 | | commissioner shall adopt a list of performance standards that a |
|---|
| 18 | 18 | | school district to which a conservator, management team, or board |
|---|
| 19 | 19 | | of managers has been appointed may meet for the conservator, |
|---|
| 20 | 20 | | management team, or board of managers to be removed. |
|---|
| 21 | 21 | | (b) The list of performance standards adopted under |
|---|
| 22 | 22 | | Subsection (a) must: |
|---|
| 23 | 23 | | (1) be based on current law and on nationwide best |
|---|
| 24 | 24 | | practices; |
|---|
| 25 | 25 | | (2) include: |
|---|
| 26 | 26 | | (A) data-driven, school-specific strategies, |
|---|
| 27 | 27 | | policies, or practices the conservator, management team, or board |
|---|
| 28 | 28 | | of managers intends to implement; |
|---|
| 29 | 29 | | (B) the desired outcomes for the strategies, |
|---|
| 30 | 30 | | policies, or practices described by Paragraph (A); and |
|---|
| 31 | 31 | | (C) data-driven benchmarks and incremental goals |
|---|
| 32 | 32 | | for the district to meet for the conservator, management team, or |
|---|
| 33 | 33 | | board of managers to be removed; and |
|---|
| 34 | 34 | | (3) be published on the agency's Internet website. |
|---|
| 35 | 35 | | (c) As soon as practicable after a school district meets all |
|---|
| 36 | 36 | | performance standards adopted under Subsection (a), the |
|---|
| 37 | 37 | | commissioner shall remove the conservator, management team, or |
|---|
| 38 | 38 | | board of managers appointed to the district. |
|---|
| 39 | 39 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 40 | 40 | | of this Act, the commissioner of education shall adopt the list of |
|---|
| 41 | 41 | | performance standards as required by Section 39A.908, Education |
|---|
| 42 | 42 | | Code, as added by this Act. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
