| 9 | 11 | | SECTION 1. Section 401.0525(c), Health & Safety Code, is |

| 10 | 12 | | amended to read as follows: |

| 11 | 13 | | (c) With the exception of a permit for a storage facility |
|---|
| 12 | 14 | | located at the site of [currently or formerly operating] nuclear |
|---|
| 13 | 15 | | power reactors and [currently or formerly operating] nuclear |
|---|
| 14 | 16 | | research and test reactors operated by a university, the commission |
|---|
| 15 | 17 | | may not under the authority given to the agency under Section 301, |
|---|
| 16 | 18 | | 304, or 401 of the Clean Water Act (33 U.S.C. Sections 1311, 1314, |

| 17 | 19 | | and 1341) issue a general construction permit or approve a |

| 18 | 20 | | Stormwater Pollution Prevention Plan under Section 26.040, Water |
|---|
| 19 | 21 | | Code, or issue a permit under the Texas Pollutant Discharge |

| 20 | 22 | | Elimination System Program under Section 26.027, 26.028, or 26.121, |

| 21 | 23 | | Water Code, for the construction or operation of a facility that is |

| 22 | 24 | | licensed for the disposal or storage of high-level radioactive |

| 23 | 25 | | waste by the United States Nuclear Regulatory Commission under 10 |
