77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of public school students who are children
1010 of certain public servants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 25.0344, Education Code, as added by
1313 Chapters 322 (H.B. 1959) and 583 (H.B. 2892), Acts of the 88th
1414 Legislature, Regular Session, 2023, is reenacted and amended to
1515 read as follows:
1616 Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF
1717 CERTAIN PUBLIC SERVANTS [PEACE OFFICERS] [SERVICEMEMBERS]. (a) In
1818 this section:
1919 (1) "Fire fighter" has the meaning assigned by Section
2020 614.001, Government Code.
2121 (2) "Parent" includes a person standing in parental
2222 relation to a student.
2323 (3) "Peace [peace] officer" has the meaning assigned
2424 by Section 1701.001, Occupations Code.
2525 (4) [,] "Servicemember [servicemember]" means an
2626 active duty member of the armed forces of the United States, a
2727 reserve component of the armed forces of the United States, or the
2828 Texas National Guard.
2929 (b) On request of [a peace officer] [servicemember who is] a
3030 parent of [or person standing in parental relation to] a student,
3131 the board of trustees of a school district or the board's designee
3232 shall transfer the student to another district campus or to another
3333 school district under an agreement under Section 25.035, if the
3434 parent is:
3535 (1) a peace officer;
3636 (2) a servicemember; or
3737 (3) a fire fighter.
3838 (c) A transfer under this section must be to the campus or
3939 school district, as applicable, selected by the parent [peace
4040 officer] [servicemember] making the request.
4141 (d) A school district is not required to provide
4242 transportation to a student who transfers to another campus or
4343 school district under this section.
4444 SECTION 2. To the extent of any conflict, this Act prevails
4545 over another Act of the 89th Legislature, Regular Session, 2025,
4646 relating to nonsubstantive additions to and corrections in enacted
4747 codes.
4848 SECTION 3. This Act applies beginning with the 2025-2026
4949 school year.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
