98 relating to the authority of a political subdivision to regulate a
10- licensed, registered, or listed group day-care home or family home.

1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Chapter 250, Local Government Code, is amended
1312 by adding Section 250.014 to read as follows:
14- Sec. 250.014. GROUP DAY-CARE HOME AND FAMILY HOME
15- REGULATORY CERTAINTY. A political subdivision may not adopt or
16- enforce an ordinance, order, or other measure that requires a group
17- day-care home or family home licensed, registered, or listed under
18- Chapter 42, Human Resources Code, to comply with health and safety
19- standards that exceed the standards established by statute or
20- Health and Human Services Commission rule.
13+ Sec. 250.014. LICENSED CHILD-CARE HOME, REGISTERED OR
14+ LISTED FAMILY HOME REGULATORY CERTAINTY. (a) A political
15+ subdivision may not adopt or enforce an ordinance, order, or other
16+ measure that requires a licensed child-care home or family home
17+ registered or listed under Chapter 42, Human Resources Code, to
18+ comply with health and safety standards that exceed those set forth
19+ in statute or by rule of the Texas Health and Human Services
20+ Commission.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2025.
