| 9 | 9 | | relating to accelerated instruction for public school students who |

| 10 | 10 | | fail to achieve satisfactory performance on certain assessment |

| 11 | 11 | | instruments. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 28.0211(a-1), Education Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (a-1) Each time a student fails to perform satisfactorily on |
|---|
| 16 | 16 | | an assessment instrument administered under Section 39.023(a) or |
|---|
| 17 | 17 | | (l) in the third, fourth, fifth, sixth, seventh, or eighth grade or |
|---|
| 18 | 18 | | an end-of-course assessment instrument administered under Section |
|---|
| 19 | 19 | | 39.023(c), other than an assessment instrument developed or adopted |
|---|
| 20 | 20 | | based on alternative academic achievement standards, the school |
|---|
| 21 | 21 | | district in which the student attends school shall provide to the |
|---|
| 22 | 22 | | student accelerated instruction in the applicable subject area |
|---|
| 23 | 23 | | [during the subsequent summer or school year] and, subject to |
|---|
| 24 | 24 | | Subsections (a-7) and (a-8), either: |
|---|
| 25 | 25 | | (1) allow the student to be assigned a classroom |
|---|
| 26 | 26 | | teacher who is certified as a master, exemplary, or recognized |
|---|
| 27 | 27 | | teacher under Section 21.3521 for the subsequent school year in the |
|---|
| 28 | 28 | | applicable subject area; or |
|---|
| 29 | 29 | | (2) provide the student supplemental instruction |
|---|
| 30 | 30 | | under Subsection (a-4). |
|---|
| 31 | 31 | | SECTION 2. Sections 28.0211(a-2) and (a-3), Education Code, |
|---|
| 32 | 32 | | are repealed. |
|---|
| 33 | 33 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 34 | 34 | | school year. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2025. |
