77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to accelerated instruction for public school students who
1010 fail to achieve satisfactory performance on certain assessment
1111 instruments.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 28.0211(a-1), Education Code, is amended
1414 to read as follows:
1515 (a-1) Each time a student fails to perform satisfactorily on
1616 an assessment instrument administered under Section 39.023(a) or
1717 (l) in the third, fourth, fifth, sixth, seventh, or eighth grade or
1818 an end-of-course assessment instrument administered under Section
1919 39.023(c), other than an assessment instrument developed or adopted
2020 based on alternative academic achievement standards, the school
2121 district in which the student attends school shall provide to the
2222 student accelerated instruction in the applicable subject area
2323 [during the subsequent summer or school year] and, subject to
2424 Subsections (a-7) and (a-8), either:
2525 (1) allow the student to be assigned a classroom
2626 teacher who is certified as a master, exemplary, or recognized
2727 teacher under Section 21.3521 for the subsequent school year in the
2828 applicable subject area; or
2929 (2) provide the student supplemental instruction
3030 under Subsection (a-4).
3131 SECTION 2. Sections 28.0211(a-2) and (a-3), Education Code,
3232 are repealed.
3333 SECTION 3. This Act applies beginning with the 2025-2026
3434 school year.
3535 SECTION 4. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2025.
