77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain requirements regarding a contract between a
1010 single source continuum contractor and the Department of Family and
1111 Protective Services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 264.165, Family Code, is amended to read
1414 as follows:
1515 Sec. 264.165. NOTICE REQUIRED FOR EARLY TERMINATION OF
1616 CONTRACT. (a) A single source continuum contractor may terminate a
1717 contract entered into under this subchapter by providing notice to
1818 the department and the commission of the contractor's intent to
1919 terminate the contract not later than the 180th [60th] day before
2020 the date of the termination.
2121 (b) The department may terminate a contract entered into
2222 with a single source continuum contractor under this subchapter by
2323 providing notice to the contractor of the department's intent to
2424 terminate the contract not later than the 180th [30th] day before
2525 the date of termination.
2626 SECTION 2. Section 264.166, Family Code, is amended by
2727 amending Subsection (c) and adding Subsection (d) to read as
2828 follows:
2929 (c) If a single source continuum contractor gives notice to
3030 the department of an early contract termination or the department
3131 gives notice to the contractor of the department's intent to
3232 terminate the contract, the department may enter into a contract
3333 with a different contractor for the sole purpose of assuming the
3434 contract that is being terminated.
3535 (d) Notwithstanding any other law, the department may enter
3636 into a contract with a different single source continuum contractor
3737 under Subsection (c) without following competitive bidding,
3838 advertising, or proposal evaluation requirements, including
3939 requirements under Section 2155.083, 2155.132, or 2155.144,
4040 Government Code, or Section 40.058, Human Resources Code.
4141 SECTION 3. The change in law made by this Act applies only
4242 to a contract entered into or amended, modified, renewed, or
4343 extended on after the effective date of this Act. A contract
4444 entered into or amended, modified, renewed, or extended before the
4545 effective date of this Act is governed by the law in effect on the
4646 date the contract was entered into or amended, modified, renewed,
4747 or extended, and the former law is continued in effect for that
4848 purpose.
4949 SECTION 4. This Act takes effect September 1, 2025.
