10 | 10 | | single source continuum contractor and the Department of Family and |

11 | 11 | | Protective Services. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 264.165, Family Code, is amended to read |
---|
14 | 14 | | as follows: |
---|
15 | 15 | | Sec. 264.165. NOTICE REQUIRED FOR EARLY TERMINATION OF |
---|
16 | 16 | | CONTRACT. (a) A single source continuum contractor may terminate a |
---|
17 | 17 | | contract entered into under this subchapter by providing notice to |
---|
18 | 18 | | the department and the commission of the contractor's intent to |
---|
19 | 19 | | terminate the contract not later than the 180th [60th] day before |
---|
20 | 20 | | the date of the termination. |
---|
21 | 21 | | (b) The department may terminate a contract entered into |
---|
22 | 22 | | with a single source continuum contractor under this subchapter by |
---|
23 | 23 | | providing notice to the contractor of the department's intent to |
---|
24 | 24 | | terminate the contract not later than the 180th [30th] day before |
---|
25 | 25 | | the date of termination. |
---|
26 | 26 | | SECTION 2. Section 264.166, Family Code, is amended by |
---|
27 | 27 | | amending Subsection (c) and adding Subsection (d) to read as |
---|
28 | 28 | | follows: |
---|
29 | 29 | | (c) If a single source continuum contractor gives notice to |
---|
30 | 30 | | the department of an early contract termination or the department |
---|
31 | 31 | | gives notice to the contractor of the department's intent to |
---|
32 | 32 | | terminate the contract, the department may enter into a contract |
---|
33 | 33 | | with a different contractor for the sole purpose of assuming the |
---|
34 | 34 | | contract that is being terminated. |
---|
35 | 35 | | (d) Notwithstanding any other law, the department may enter |
---|
36 | 36 | | into a contract with a different single source continuum contractor |
---|
37 | 37 | | under Subsection (c) without following competitive bidding, |
---|
38 | 38 | | advertising, or proposal evaluation requirements, including |
---|
39 | 39 | | requirements under Section 2155.083, 2155.132, or 2155.144, |
---|
40 | 40 | | Government Code, or Section 40.058, Human Resources Code. |
---|
41 | 41 | | SECTION 3. The change in law made by this Act applies only |
---|
42 | 42 | | to a contract entered into or amended, modified, renewed, or |
---|
43 | 43 | | extended on after the effective date of this Act. A contract |
---|
44 | 44 | | entered into or amended, modified, renewed, or extended before the |
---|
45 | 45 | | effective date of this Act is governed by the law in effect on the |
---|
46 | 46 | | date the contract was entered into or amended, modified, renewed, |
---|
47 | 47 | | or extended, and the former law is continued in effect for that |
---|
48 | 48 | | purpose. |
---|
49 | 49 | | SECTION 4. This Act takes effect September 1, 2025. |
