77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of a bet for gambling criminal offenses
1010 purposes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 47.01, Penal Code, is amended by
1313 amending Subdivision (1) and adding Subdivision (7-a) to read as
1414 follows:
1515 (1) "Bet" means an agreement to win or lose something
1616 of value solely or partially by chance. A bet includes an offer to
1717 win a prize, award, or compensation to participants of a paid
1818 fantasy sports league. A bet does not include:
1919 (A) contracts of indemnity or guaranty, or life,
2020 health, property, or accident insurance;
2121 (B) an offer of a prize, award, or compensation
2222 to the actual contestants in a bona fide contest for the
2323 determination of skill, speed, strength, or endurance or to the
2424 owners of animals, vehicles, watercraft, or aircraft entered in a
2525 contest; or
2626 (C) an offer of merchandise, with a value not
2727 greater than $25, made by the proprietor of a bona fide carnival
2828 contest conducted at a carnival sponsored by a nonprofit religious,
2929 fraternal, school, law enforcement, youth, agricultural, or civic
3030 group, including any nonprofit agricultural or civic group
3131 incorporated by the state before 1955, if the person to receive the
3232 merchandise from the proprietor is the person who performs the
3333 carnival contest.
3434 (7-a) "Paid fantasy sports league" means a contest in
3535 which:
3636 (A) the value of any prize, award, or
3737 compensation is established in advance of the beginning of the
3838 contest or of a sporting event on which the contest is based;
3939 (B) participants:
4040 (i) pay a fee to participate in the contest;
4141 and
4242 (ii) assemble a fictional sports team
4343 composed of actual professional or amateur athletes to compete
4444 against fictional sports teams assembled by other participants for
4545 the chance to win a prize, award, or compensation;
4646 (C) any part of the contest's outcome is
4747 determined by the actual weekly performances in sporting events of
4848 the individual athletes on a participant's fictional sports team;
4949 and
5050 (D) a portion of the fees collected from
5151 participants is retained by the person who offers the contest and is
5252 not paid to participants as a prize, award, or compensation.
5353 SECTION 2. The change in law made by this Act applies only
5454 to an offense committed on or after the effective date of this Act.
5555 An offense committed before the effective date of this Act is
5656 governed by the law in effect on the date the offense was committed,
5757 and the former law is continued in effect for that purpose. For
5858 purposes of this section, an offense was committed before the
5959 effective date of this Act if any element of the offense occurred
6060 before that date.
6161 SECTION 3. This Act takes effect September 1, 2025.
