77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the designation of a weight enforcement officer by a
1010 commissioners court in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 621.4015(a), Transportation Code, is
1313 amended to read as follows:
1414 (a) A county commissioners court may designate a constable
1515 or deputy constable of the county as a weight enforcement officer in
1616 a county:
1717 (1) that is a county with a population of 1.5 million
1818 or more and is within 200 miles of an international border; [or]
1919 (2) that is adjacent to a county with a population of
2020 3.3 million or more, [;] and
2121 [(3)] in which a planned community is located that has
2222 20,000 or more acres of land, that was originally established under
2323 the National Urban Policy [Growth] and New Community Development
2424 Act of 1970 (42 U.S.C. Section 4501 et seq.), and that is subject to
2525 restrictive covenants containing ad valorem or annual variable
2626 budget based assessments on real property; or
2727 (3) that has a population of more than 75,000 but less
2828 than 90,000 and is adjacent to a county described by Subdivision
2929 (2).
3030 SECTION 2. This Act takes effect September 1, 2025.
